Putting “Getting Things Done” in Context

As a Bernie supporter dating back to 2016, many things stick in my proverbial craw, but one turn of phrase even today still grinds my likewise proverbial gears. When asked during a Democratic debate in October 2015 by Anderson Cooper whether she is a moderate or a progressive, Hillary Clinton remarked, “I’m a progressive, but I’m a progressive who likes to get things done.”

Ooh! Sen. Sanders, did you feel that sick burn?

Without wanting to delve into Clinton’s history and go tit for tat, pointing out all the things she may not have “gotten done”—like, for instance, actually winning the 2016 presidential election—the litmus test of getting things done remains problematic because of how unevenly and borderline disingenuously it gets applied, specifically as it concerns authentically progressive candidates.

For that matter, I’ve witnessed it being used by supporters of one progressive candidate against another. You probably have an idea about where I’m going with this. Anecdotally, I’ve seen some Elizabeth Warren fans take shots at Bernie, asking, for all his 28 years in the House of Representatives and the Senate, what has he, you know, done? Presumably, some of these Warren supporters were Hillary supporters from the last campaign cycle, so the same line of attack about what the senator from Vermont has accomplished may yet be fresh in their minds. For a select few, there may additionally be some misdirected resentment in accordance with the notion Bernie is not a “true Democrat” and was a chief reason why Donald Trump won. Poor Hillary. It’s never her fault.

Key to the do-nothing-Bernie argument is a glance at his legislative record, particularly the legislation for which he was primary sponsor actually getting enacted. His objectors will point out that, in over two decades in Congress, Sanders has only had seven of his resolutions/bills ratified: four from his time in the House, three in the Senate. Five of these motions enacted are germane mostly to his home state, including two pieces of legislation which served to designate post offices after someone specific. Not altogether scintillating stuff. The other two specifically addressed cost-of-living adjustments for veterans and updating the federal charter for the Veterans of Foreign Wars. Again, you may find yourself uninspired unless you were specifically impacted by these changes.

What this line of thinking fails to account for is the context in which these bills were introduced. After all, this is Congress we’re talking about here, an institution not exactly known for its prolific productivity. The very GovTrack.us showcase of Sanders’s sponsored legislation linked to above helps explain this reality.

Does 7 not sound like a lot? Very few bills are ever enacted — most legislators sponsor only a handful that are signed into law. But there are other legislative activities that we don’t track that are also important, including offering amendments, committee work and oversight of the other branches, and constituent services.

Right. There’s a bigger picture to be appreciated. On the subject of committee work, Bernie is a ranking member of the Senate Committee on the Budget and a member of the Health, Education, Labor, and Pensions; Energy and Natural Resources; Environment and Public Works; and Veterans’ Affairs committees. So there’s that.

Such analysis also doesn’t consider the over 200 bills/resolutions signed by the president to which Sanders added his name as a co-sponsor since being sworn in as a U.S. Representative in 1991. As it must be clarified, not all of these are watershed legislative achievements. I mean, from my count, nine of these co-sponsorships were related to commemorative coins. Still, to imply inaction on Bernie’s part is misleading.

Moreover, this ignores all the times Sen. Sanders has shown leadership on a bill that, through no fault of his own, hasn’t been passed. Look at his recent offerings. Recognizing the “climate emergency” for what it is. College for All. Medicare for All. Social Security expansion. Raising wages. Lowering drug prices. These were all proposed this year. Just because this legislation is dead on arrival in a GOP-controlled Senate with a Republican in the White House doesn’t confer meaninglessness. It signals the individual proposing it is willing to fight for things worth fighting for.

This is before we even get to the issue of when political expediency “gets things done” but not necessarily in a way that is productive for all Americans. Back in June, Joe Biden touted his ability to work with the likes of James Eastland and Herman Talmadge to pass legislation, waxing nostalgic on the “civility” that could be afforded to all parties.

Beyond the obvious problem that Biden is touting his ability to work with Southern segregationists in—let me highlight this in my notes—2019, that communal effort may not be what it’s cracked up to be. The former VP has received his due criticism from Kamala Harris and other Democratic rivals for allying with segregationists in opposition of busing to integrate schools. Next to his legacy as “an architect of mass incarceration,” as Cory Booker put it, Biden’s willingness to compromise paints him in a rather poor light. It certainly clouds his purported credentials of being a champion of civil rights.

It’s not just with Bernie either. Across the board for Democrats, it seems instructive to view legislative efforts through the lens of what party controls each house and who is potentially waiting to sign a passed bill in the Oval Office. Republicans, led by shameless obstructionist and judiciary stacker Mitch McConnell, control the Senate. Donald Trump, who appears to have a death grip on today’s iteration of the GOP, is president. Should we fault Sen. Warren for watching Trump and Co. dismantle the Consumer Financial Protection Bureau before her eyes? Should we admonish Alexandria Ocasio-Cortez and other members of The Squad for voting their conscience only to see Senate Republicans or moderate Democrats in either house stand in their way?

Centrists like Nancy Pelosi may sneer at progressives who “have their following” only to see their votes outnumbered or their voices drowned out by appeals to civility and expediency. Absent the ability to lead, however, the progress they seek is all but nullified. There’s a reason why figures like Sanders and AOC are so popular when Congress as a whole is not. The policy positions they embrace are, by and large, supported by the American public. What’s not lacking is their commitment. It’s the political will to see their initiatives through.


Key to the Clintonian-Bidenesque “getting things done” mentality is a firm belief in the value of bipartisanship, of reaching across the aisle in the name of advancing legislation. Say the right things. Make the right amendments. Pull the right levers. Eventually, a workable bill will come out. That’s how things are supposed to work, in theory. Reasonable people making reasonable policies.

Amid the dysfunction of today’s Congress, this ideal still appears to hold water with the general public. How else to explain Joe Biden’s continued hold on the top of Democratic Party polls after two poor showings in the debates and despite a history of gaffes and poor decisions? Unless some voters are simply happy enough to have some semblance of Barack Obama’s presidency back. If we could just go back to the days before the era of President Donald Trump, everything would be back to normal, right?

Maybe, maybe not. Biden may reminisce fondly about the days when Democrats and Republicans could get along peaceably or believe that once “sensible” leadership is restored to Washington, the GOP will cut the malarkey and retake the mantle of responsible stewards of the country. He arguably both underestimates the polarization of the current political climate and overestimates his own deal-making ability in doing so, though.

Today’s Republican Party isn’t your granddaddy’s Republican Party, simply put. Not when the president is lashing out against his critics on Twitter daily, getting policy directives from FOX News, and putting the nation on the path to a dictatorship. Not when members of the party are actively denying the severity of our climate crisis or pretending that white nationalism doesn’t exist. Not when party leaders are defending the inhumane treatment of migrants at our border and are sharing derogatory memes about Alexandria Ocasio-Cortez and her progressive colleagues with impunity.

For those of us who aren’t old enough to recall an environment like the one Biden envisions, this is all we know of the GOP, and based on how low it has sunk and continues to sink, there’s every reason to believe it has reached the point of no return—if things were even that good to begin with. Once we take off our rose-colored glasses and re-appraise past decisions from intersectional perspectives, we may come to realize just how devastating certain policies spearheaded by both parties have been for Americans outside the so-called ruling class.

In addition to his checkered civil rights record, Biden’s cozy relationship with the banking, financial services, and insurance industries contrasts starkly with his image as a blue-collar champion. Given a crowded Democratic primary field and ample resources with which to evaluate his overall record, this may turn out to be a liability. That is, even if he earns the party nomination, there’s still the matter of the general election. Trump seemingly defied the odds against Hillary Clinton, in many respects a superior candidate. Who’s to say doubling down on someone like Biden won’t backfire, leaving us with a second term of President Trump? If he’s doing and saying all these reprehensible things now, what will this mean when he gets re-elected and has nothing to lose?

Going back to the days of bipartisan cooperation under past administrations may have its superficial appeal to voters, especially moderate whites who can better afford to be casual political participants. Even that relative comfort may be illusory, however. The climate emergency is not going to fix itself. Nor is the student debt crisis or the health care affordability crisis or our crumbling infrastructure or any other serious dilemma facing our world. Simply put, the stakes are higher now and Obama-era notions of hope and change dissolving into incrementalism aren’t sufficient. It’s going to take more than that. It’s going to take real people power.

Let’s therefore put aside vague, top-down conceptualizations of “getting things done” in favor of mobilizing voters and encouraging citizens to get involved at various levels of government. We’ve got the people. We only need the conviction to see it through. If you’re not on board with a progressive vision for our future, don’t worry about what is politically “feasible” or what can get done. Worry about getting out of the way of those determined to lead.

In Nancy We Trust?

A disciplined leader. A woman focused on specific policies that affect people’s lives. Someone who gets results. These are among Will Saletan’s characterizations of Nancy Pelosi as expressed in a largely laudatory recent piece written about her for Slate.

Before we get to the meat of Saletan’s article, titled simply “Trust Pelosi,” there’s the matter of a profile of Speaker Pelosi by Glenn Thrush that appeared earlier this month in The New York Times, of which Saletan’s essay serves primarily as a reaction piece. Thrush shines a spotlight on Pelosi’s stewardship of the Democratic Party, particularly as it intersects with notions of impeachment and taking back the White House in 2020.

As Pelosi would have it, impeachment is not the way to remove Donald Trump from the Oval Office. It’s beating him in the upcoming presidential election—soundly. Otherwise, Trump et al. might contest any Democratic victory as illegitimate. Impeachment proceedings are all but guaranteed to stall in the Senate and the ensuing confrontation would likely energize Trump and his supporters. Rather than risk alienating moderates, Pelosi believes in “owning the center left to own the mainstream” rather than “engaging in some of the other exuberances that exist in [the Democratic Party].” That is, more Affordable Care Act and less Medicare-for-All. Sorry (not sorry), progressives.

What about other elements of the current American political landscape? How does Ms. Pelosi feel about recent events which stand to affect the balance of power in Washington, D.C.? On the increasingly troublesome handling of the Mueller probe/report by Attorney General William Barr juxtaposed with the ever-erratic behavior of the president, while Pelosi finds it testing her commitment to no impeachment, she remains firm on this point, even if privately she thinks he (Trump) has earned this treatment several times over. On the field of potential Democratic challengers to Trump? Pelosi sees Joe Biden’s popularity in the polls as a symbol of voters’ familiarity and trust, dismissing concerns about his 90s-era treatment of Anita Hill. On working with Republicans? Pelosi is for it, notably if it can help Democrats retain or win hotly contested congressional seats.

There you have it. The communicator of a simple message. Tough as nails. Able to keep rogue members of the party from “hijacking” the House Democratic Caucus. Cordial when the occasion arises but willing to clap back (literally) when the circumstances invite such behavior. It’s Nancy, bitch. Deal with it.

This is the backdrop against which we view Saletan’s own analysis on Pelosi’s role as de facto party leader until a presidential nominee is chosen. As he views subsequent criticism by progressives related to her comments in Thrush’s feature, it is “overblown.” Along these lines, Saletan points to several reasons why Pelosi should make “liberals from San Francisco” (as she describes herself) proud:

She’s more “progressive” than you think

If we’re judging Nancy Pelosi simply as a function of her lack of support for the Green New Deal, describing her as a “leftist” or “progressive” is understandably problematic. As Saletan argues, however, her voting record suggests she is more in step with the left than her detractors might otherwise concede. She argues for affordable health care, education investment, environmental protections, equal pay, fair wages, gun safety, immigration reform, infrastructure investment, protecting Social Security, women’s rights, and other tenets of the party platform most people on the left can broadly agree on. Since Donald Trump took office and as of this writing, Pelosi has voted with the president’s position 18.6% of the time, as calculated and tracked by FiveThirtyEight. That’s not dissimilar from someone like Tulsi Gabbard (20.5%) and significantly lower than Beto O’Rourke (30.1%).

For Pelosi, it is more advantageous to defend policy stances that “are well understood and supported” against the other side’s attacks rather than advancing big ideas that might “alarm the other side’s voters more than they inspire yours.” Hence the focus on the ACA rather than Medicare-for-All and on elements of the Act for which polls already show broad support.

She focuses on policies, not ideologies

For Pelosi, the name of the game is connecting with undecided voters and on maintaining, if not further cementing, the Democratic Party’s control of the House. Concerning the former, she makes a point of avoiding belaboring talk about Trump in favor of highlighting the ways Democrats are fighting for everyday Americans, pointing to the tangible benefits of their policy goals (e.g. framing the climate change issue as a jobs issue). On the latter, Pelosi wants to make sure vulnerable Democratic incumbents in “purple” districts are protected, arguing that there aren’t enough deep-blue districts to approach things the way progressives might prefer. After all, if Republicans regain a House majority, the progressive agenda becomes moot, at least in a pragmatic sense.

To this effect, the speaker emphasizes values over movements. As Saletan underscores, for instance, she is much more apt to describe positions in terms of their purported “fairness” than evocative of “socialism,” a term which carries baggage and is used by the right to try to engender opposition and fear. Pelosi’s vision of the Democratic Party is one of an appeal to pragmatic reason and to voters in the center “abandoned” by the GOP.

She seeks to connect to voters’ values rather than demonizing the right

Continuing with the idea that Democrats can own the center Republicans have forsaken, Rep. Pelosi hopes to sway voters who lean Republican but may be critical of Pres. Trump to vote blue, contrasting his record with that of former presidents like Ronald Reagan. In making such a pitch, she stresses the importance of “values” as a practicing Catholic. The environment. Health care. Separating families at the border. These are values issues, ones that Americans who hold deeply religious views can consider as a subset of their faith. Moreover, by making appeals in this way, Pelosi is speaking to those who vote with their gut rather than based on a comprehensive understanding of policies.

She believes in impeachment, but wants the public’s support

To the extent that impeachment proceedings would die in the Senate or would be used to energize Trump’s base, Pelosi approaches such a move with trepidation. On this note, she favors continuing House committee hearings that build on what we know from the Mueller report and other investigations, hoping to turn public sentiment against Trump much in the way Americans turned against Richard Nixon in the wake of months of investigation into his (mis)conduct. Quoting Pelosi in the final moments of his piece, Saletan closes with these thoughts:

On the whole, the speaker has it right. “Public sentiment is everything,” she likes to say, paraphrasing Abraham Lincoln. “With it, you can accomplish almost anything. Without it, practically nothing.” Pelosi schooled Trump in the fight over the government shutdown, and she’s patiently waiting him out in the standoff over who will propose taxes to pay for an infrastructure plan. The liberals of San Francisco should be proud.

While “schooling” Trump may seem an almost dubious achievement—the man’s penchant for malapropisms and spelling errors have become the stuff of legends in the age of Twitter—it seems certain that Pelosi is well-equipped to deal with him. You know, as well as anyone can reasonably deal with a man-child like Trump.

Anecdotally speaking, in my online discussions and in-person Democratic club meetings, Pelosi’s stature is that of a female legislative icon beyond her historic identity as the first (and only) woman to serve as Speaker of the House. Despite misgivings about her leadership in advance of this Congress, she has weathered that storm and is apparently not going anywhere anytime soon. For most rank-and-file Democratic supporters, that’s at least “somewhat favorable.”


The thrust of Will Saletan’s and Glenn Thrush’s articles may well agree with what they believe personally. In Saletan’s case, it is an opinion piece, so we would envision his views and Nancy Pelosi’s align somewhat closely. In Thrush’s case, this is a report that cites Pelosi directly, so the author’s personal inclinations are less clear, though there is very little if any pushback against her assertions within.

In a day and age in which memes are accepted as fact and in which publications are bidding to outdo one another in terms of clicks and exclusives that break before anyone else, though, the sources of the information we consume should be considered for potential bias. Slate, though fairly liberal among mainstream news outlets, has existed under the Washington Post banner since its acquisition in 2004. The New York Times, irrespective of accusations on the part of Donald Trump and other conservatives, also tends to promote an outlook that falls left of center.

Even so, these companies are part of a network of news sources backed at least in part by money linked to major corporations or wealthy patrons. The Washington Post, as of 2013, has existed under the ownership of Nash Holdings, a limited liability holding company established by Amazon CEO and founder Jeff Bezos. The New York Times is publicly traded and controlled by the Sulzberger family by means of two classes of shares, of which Mexican billionaire Carlos Slim Helú is the largest single shareholder. Journalist Matt Taibbi notably criticized the Times‘s favoritism of Hillary Clinton over the grassroots-oriented candidate Bernie Sanders in the 2016 Democratic Party presidential primary. These purveyors of news may be left of cable news conglomerates and are certainly far removed from the likes of Breitbart, The Drudge Report, Glenn Beck, and InfoWars, but they still may reflect more of a centrist or elitist bias than their readers, hungry for content and subject to their own biases.

In the case of Nancy Pelosi, access to a politician of her stature and a desire to appeal to a readership fueled by anger at the president likely informs the essentially congratulatory tones of these features. With all due respect, Saletan acknowledges that Pelosi’s strategy “is open to dispute.” For one, the praise of Ronald Reagan and other Republican leaders of yesteryear is fraught with complications; ask communities of color ravaged by the war on drugs or the LGBTQ community ignored during the peak of the AIDS crisis and see if they’re as charitable in their recollections.

There’s also the matter of not wanting to criticize Trump for fear of antagonizing those who voted for him, a tactic which Saletan indicates arguably plays better in deep-red districts than as a one-size-fits-all methodology. Other possible points of contention are her adherence to centrism in the hopes of warding off moderate Republicans challenging for House seats (“that might be playing it too safe”) and her harping on the likelihood that Trump will contest the results of the 2020 election if they go against him (Saletan suspects “she’s using that scenario as a scare tactic to motivate her troops”). Trump and his ilk routinely turn molehills into mountains or simply fabricate those mountains entirely. This sadly might be an inevitability.

Speaking as someone who ascribes to a progressive mindset, my biggest concern is that Speaker Pelosi seems to both overestimate the American people’s ability to handle worsening economic and environmental trends and underestimate her party’s supporters. Regarding her dismissal of Medicare-for-All, the Green New Deal, and other progressive policy goals, Pelosi’s positions belie the seriousness of various crises. We are in the midst of a climate crisis. Americans are saddled by medical, student, and other forms of debt. Income and wealth equality are widening, with far too many people in this country living in poverty or close to it. Defending the ACA and embracing incrementalism when warning signs abound conveys the sense you don’t feel the same pinch your constituents do, inviting accusations of being an out-of-touch elite, even if exaggerated.

As for the notion Democrats should prioritize policies “that are well understood and supported,” this assumes voters are not especially well-informed about or desirous of progressive policy designs. Some clearly are not. On the other hand, if the popularity of younger progressives like Alexandria Ocasio-Cortez is any indication, these ideas are not far outside the mainstream and voters, particularly young voters, are quite knowledgeable about them indeed. I keep thinking back to the episode not long ago in which Dianne Feinstein lectured a group of young environmental activists about political realities and pointed to her legislative record. Thank you for your service to this country, Sen. Feinstein. But this is serious business and if you’re not going to lead on the subject of climate change, you need to get out of the way of those who can and will.

In all, what strikes me about Nancy Pelosi’s strategic mindset and that of other establishment Democrats is that they appear content to play not to lose rather than swinging for the fences, walking on proverbial eggshells in Donald Trump’s shadow. That didn’t work in 2016, prompting one to wonder what party leadership has learned exactly since then.

To be clear, I think Pelosi’s experience and shrewdness are assets in connecting with voters. I would tend to agree that it’s useful if not essential to be able to pitch parts of a platform in different ways to different voters and voting blocs. For better or worse, not everyone is swayed by considerations of morals and presidential ethics. That said, I’m not sure her deprecation of her party’s “exuberances” convey the right message. Not when aggressive centrists like Josh Gottheimer are making House Democrats and the party look bad by extension. But sure, keep siding with him over Ilhan Omar.

In Nancy we trust? On many issues, yes. But I have my doubts—and chances are you do as well.

The Problem with Bipartisanship

Note: This post was first published before any meetings between Nancy Pelosi and the Problem Solvers Caucus. The two sides have reportedly cut a deal on proposed rule changes.

I’m not the biggest fan of Nancy Pelosi personally. Even I, though, have to balk at the recent attempts to challenge her prospective leadership as Speaker of the House.

In particular, a no-vote of confidence from members of the Problem Solvers Caucus seems to be, well, a problem, or at least a distraction. The Problem Solvers Caucus is a bipartisan group of representatives that seeks to create cooperation among members of both major parties on key policy issues. In practice, it is a centrist committee.

For the purposes of this challenge’s to Pelosi’s authority, Jim Costa (CA), Vicente González (TX), Josh Gottheimer (NJ), Daniel Lipinski (IL), Stephanie Murphy (FL), Tom O’Halleran (AZ), Kurt Schrader (OR), Darren Soto (FL), and Tom Suozzi (NY) are the Democrats who are making their support contingent on the eventual Speaker’s acceptance of certain rule changes.

As Gottheimer, caucus co-chair, identified, these #BreaktheGridlock changes involve 1) legislation going to the House floor for debate and a vote when co-sponsored by at least three-fifths of Congress, 2) an amendment to legislation getting a debate and vote with at least 20 Democratic and 20 Republican co-sponsors, and 3) each member of Congress being allowed to introduce a bill for debate and vote on a committee he or she serves on once a congressional term.

In principle, these proposals designed to “break the gridlock” are worth considering in the name of procedural reform. The timing and very public nature of this threat to Pelosi’s leadership, however, as well as the take-it-or-leave attitude accompanying it, are concerning. What’s more, when considered alongside existing feelings that the Democratic Party needs to be taken in a “new direction,” the overall picture is one of party discord at a time when gains in the House should perhaps have the Dems thinking more harmoniously.

What’s additionally striking about this turn of events is that it has come at the behest of members of a caucus that tout their bipartisan credentials, not long after Pelosi herself vowed the House would move toward greater bipartisanship. Of course, this in itself drew criticism elsewhere. That Nancy Pelosi—damned if she does and damned if she doesn’t.

Amid a spirit of partisan acrimony and congressional ineffectiveness, bipartisanship would seem to be exactly what we’d want or need. Everybody gets along, Congress actually gets meaningful things done—sounds good, right? The problem with bipartisanship as an ideal, however, is that it may be overrated, if not counterproductive.

Lew Blank, editor-in-chief of The Outsider, an independent, student-led online publication devoted to telling stories from outside the mainstream media bubble and the two-party binary, wrote in a detailed post last year (with helpful charts and graphs!) about how bipartisanship is, well, a myth. Firstly, there’s the matter of how the goal of bipartisanship tends to reduce matters to “debates” in the name of balance when there should be no room for debate. Blank starts his article thusly:

What America considers a debate is pretty messed up. Apparently, the existence of climate change is a “debate.” Allowing 33,000 Americans to die every year because they can’t afford health care is a “debate.” Continuing to arm ISIS and Al Qaeda in Syria is a “debate.”

And yet, there’s one singular issue that seems to read “case closed” in the minds of millions of Americans, both red and blue: bipartisanship. Somehow, we have wound up in a world where saying “we should stop literally arming terrorists” is an opinion, but lauding the glories of bipartisan politics is unbiased and impartial.

On top of this, and more to the point, finding bipartisan legislative solutions tends to involve compromises that skew to the political right. As Blank characterizes this relationship, centrist Democrats often strive for policies that are “both (a) conservative enough to get Republican support, and (b) liberal enough to like.”

Viewing Obama-era policy directives through this lens, however, very few, if any, of them actually ticked both boxes. Either they were too conservative for liberals to like (e.g. extending the Bush tax cuts), too liberal for conservatives to pass or support after Obama was gone (e.g. the Paris Agreement), or neither very liberal nor supported by the GOP (e.g. military expansion that still saw Obama’s critics calling him “soft on terrorism”). The wrench in compromising and finding a middle ground, as many on the left might expect, is the uncompromising position Republicans take on issue after issue. In Blank’s words, their failure to “support anything with even a tinge of progressivism” means trying to bend over backward to appease them is a non-starter.

The true solution for Democrats, then, is to run to the left. Only from this position can they negotiate and get something close to what they really want. Per Blank:

This is compromise 101. If you get an offer of $50 for a painting and you ask for $60 instead, you may come away with a solid $55. If you go the “moderate” route and raise to $51 instead, you’re missing out on a potential four dollars.

What’s more, the statistics seem to bear out that running further to the left is the better strategy from an electoral perspective. How else to explain the enduring popularity of someone like Bernie Sanders and the lingering unpopularity of someone like Hillary Clinton? Of course, popularity and social media fervor don’t necessarily equate to votes cast. Then again, capitulation is not a very sexy approach to attracting voters, especially in the context of a general election, so why not go for the gusto?

Noting the refusal of Republicans to yield on policy matters in recent years, examples of bipartisan cooperation on the part of moderate Democrats might actually be more disconcerting than anything. As alluded to before, increased military spending has continued to be approved by Congress despite the cost of human life and despite the notion this focus on “defense” dwarfs the spending on domestic programs the GOP claims we can’t afford. The Dodd-Frank rollback aided and abetted by “Blue Dog” Dems like Gottheimer also jumps to mind as one of those points of accord between parties that should inspire fear more than confidence. Coming together is all well and good when we’re paving the road to another economic collapse.

For any number of reasons, therefore, bipartisanship may not be all it’s cracked up to be. Not the least of which is, if you ask this writer, that at 14 letters, the word bipartisanship is already too long.


As with “civility,” calls for bipartisanship are only as good as the individual or individuals making such an appeal. Senate Majority Leader Mitch McConnell caught flak for an op-ed for FOX News in which he asked whether the Democrats will work with Republicans, or “simply put partisan politics ahead of the country?” The irony was not lost on, er, pretty much anyone who knows McConnell. The Republican senator from Kentucky has been the proverbial poster child for partisan obstructionism in recent years. Accordingly, the prevailing response seemed to be “Merrick Garland” and some sort of invective or gesture not printable in this space. How’s that for bipartisanship, Mr. McConnell?

Nancy Pelosi, in her stated preference to work in a bipartisan manner within Congress and with President Trump, may have been similarly full of shit—at least outwardly. That is, she may genuinely wish to work in a partnership with Trump and the GOP, but knowing his and his party’s demands, this is functionally impossible. In this respect, Pelosi’s conviviality appears to be a show of rationality and goodwill in the face of a White House that lacks it so as to make her and her party look more reasonable. Even in jest, however, the sentiment is one whose sharing has the power to boil progressives’ blood.

I’m a resident of New Jersey’s ninth congressional district, but I’m a friend of a number of progressive-minded residents of the fifth where Josh Gottheimer calls home (by crossing from one town into the next, you’re entering into a different district). And I can tell you this much: while they’re plenty relieved to have someone like Gottheimer rather than someone like John McCann or his predecessor Scott Garrett in office, they’re disappointed in this display of brazenness from the co-chair of the Problem Solvers Caucus.

This isn’t the first time he’s disappointed them either, whether it’s because he voted with the GOP or because he has avoided making his stance clear so as to not risk a backlash. On one hand, there’s the political “reality” that he represents a district which has its clearly blue and red segments, so his bipartisan mentality may have its advantages.

On the other hand, as a Democratic supporter, it makes you wonder what lines someone like Gottheimer won’t cross. A number of these friends either voted to endorse him or campaigned for him in the midterms. Their reward? Little, if any, expressed gratitude and an overt attempt to undermine their party’s leadership. It should be no surprise that there’s already talk of wanting a primary challenge to Gottheimer’s seat in the House. For my part, I think all incumbents should be challenged as a matter of procedure and because it makes for better party platforms, but I sympathize with this desire.

Though it may go without saying at this point, there’s a financial aspect to this effort to contest Pelosi’s leadership heretofore unmentioned. As Ryan Grim of The Intercept reports, political/corporate consultant Mark Penn and No Labels, a bipartisan group funded by wealthy donors, are the driving force behind this revolt. Gottheimer and Penn, described by Grim as “one of the most toxic and notorious partisan warriors the Democratic Party has produced in the past three decades,” have a history together dating back to the Bill Clinton White House.

Members of no Labels, described by critics as “aggressively” centrist, have had an ax to grind against Pelosi for some time now. While they may have softened their position to make her Public Enemy #1—when in doubt, Bernie Sanders makes a convenient target—that ill will has evidently lingered.

There’s ample room for debate whether or not Nancy Pelosi, a seeming epitome of the “old guard” of Democratic Party leadership, is the right person for the role of Speaker of the House come January. Certainly, though, this attack on her from the Problem Solvers Caucus is one to be disparaged, as their insistence on “breaking the gridlock” purely as a function of their moderate ideology rings hollow.

In all, the Democrats’ commitment to bipartisanship without any show of good faith from the Republican Party is a questionable tack to take. It’s bad negotiating on top of poor electoral strategy, and its effectiveness as a tool to rally the base is similarly suspect. With the Dems needing a big win in 2020 to continue their momentum, that’s a problem.

Undermining Democracy, GOP-Style

NoteSince this was originally posted, Andrew Gillum has refused to concede despite gaining only one vote in a recount, and Stacey Abrams has acknowledged defeat but isn’t calling it a “concession” and plans to file a federal lawsuit over mismanagement of the vote in Georgia. Bill Nelson’s hopes for a win via recount are also slim to none.

When it comes to the present-day incarnation of the Republican Party, always beware the shell game. 

Per Dictionary.com, shell game is defined as “a sleight-of-hand swindling game resembling thimblerig but employing walnut shells or the like instead of thimblelike cups.” If you’re familiar with the setup of three-card Monte, the logistics are essentially the same, only with cards instead of shells. Find the pea (or the Queen of Hearts) under the shell. Double-down on your ability to find it again. If you’re successful, you win big. If you’re not, the opposite happens.

With Donald Trump, Con-Man-in-Chief, working in cahoots with a party whose agenda seems increasingly predicated on deception—so that you don’t discover how bad their policies actually are for you or the country at large—this diversionary tactic is alive and well. Before your eyes, numerous issues await your attention, but energy/money/time being limited, you can only pick one on which to act at the risk of having all three suffer.

Concerning the events of the last week and change, three “shells” jump to mind being of national import, especially fresh after Election Day. All merit scrutiny as threats to democracy, and yet, there aren’t enough hours in the day.

That press conference

President Trump has had some stupendously bad press conferences during his tenure, but his post-election presser, if not the outright worst, ranks right up there. There’s a lot to unpack here, so let’s get to the nitty-gritty, shall we?

  • The great and powerful Republican Party: First things first, Trump started by lionizing the GOP’s “achievements.” Apparently, not losing control of the Senate and ceding control of the House qualify. At any rate, they were achievements because the Democrats had an unfair advantage in fundraising from special interests and wealthy donors and because the media is so gosh-darned mean to Republican candidates. Also, we had a bunch of retirements. But we had big rallies! And we did better than Obama! The country is booming! If the Democrats don’t screw everything up, we’ll all be united and thriving together!
  • On bipartisanship: With the whining about the Republicans’ handicap thus dispensed with, it was time for questions. First up, about that spirit of bipartisanship he and Nancy Pelosi talked about. Like, that’s not really going to happen, right? Especially with all the investigations expected to be going on and unless y’all compromise? Trump demurred on the issue. No, we’re totally going to be able to work together with the Democrats. Of course, if we can’t, they’re the ones in control of the House, so you know—their fault.
  • Oh, that border wall… We’re gonna build the wall. We’ve already started building it, in fact. Just try and stop it. The American people want it. The Democrats want it—they just don’t want to admit it. Fine by me. I’ll take the political capital and run with it. But the caravan is coming, ladies and gents. I can’t say for sure that I’d advocate shutting down the government for it. But come on—I totally would.
  • On the ever-tumultuous Cabinet: Trump is totally happy with his Cabinet. Good Cabinet. Great Cabinet. As long as no one suddenly displeases him, he has love for all. At this point, in a completely unrelated move, the President pushed a button revealing a pool of sharks underneath the floor and lowering a human-sized cage suspended above it from the ceiling. 
  • The Jim Acosta portion of the program: If there’s one moment of the press conference you heard about, it was likely this. CNN’s Jim Acosta, established persona non grata among Trump’s base, pressed Trump on referring to the migrant caravan in Central America as an “invasion.” Trump was all, like, well, consider it an invasion. Acosta was all, like, but that caravan is hundreds and hundreds of miles away and you’re demonizing immigrants by showing them climbing over walls, which they’re not going to do. And that’s when things got really interesting. As Trump settled into Attack Mode, Acosta tried to ask a follow-up question. Trump was all, like, you’ve had enough, pal. Nevertheless, he persisted, trying to ask about the Russia investigation. Meanwhile, a female aide tried to grab the mic away from Acosta, which he stifled with a “Pardon me, ma’am” and a hand on her arm. Before Acosta relented, Trump called the investigation a “hoax” and called Acosta a “rude, terrible person.” Fun times.
  • More about the Jim Acosta portion of the program: NBC News’s Peter Alexander came to Acosta’s defense as next reporter up—only to get harangued by the President in his own right—but the implications of this kerfuffle and the subsequent revocation of Acosta’s press privileges in covering the White House are serious. I don’t care what you think about Acosta personally, even if you feel he’s a self-aggrandizing hack. Judging by the smarmy attitude of other CNN personalities like Anderson Cooper and Chris Cuomo, elevated self-appraisals seem to be a fairly common occurrence there. I also don’t care what you think about Barack Obama’s frosty relationship with FOX News and the questionable treatment its reporters received at the hands of the Obama White House. On the latter count, two wrongs don’t make a right, and if Trump and Co. want to distinguish themselves, they should do it by being better and less petty—not the other way around. To that effect, squelching Acosta’s voice in a dictatorial way should be concerning no matter where you stand politically in the name of journalistic integrity and a free press. And let’s not start with the whole “Acosta assaulted that young woman” narrative. If you’re relying on a doctored InfoWars clip to make your argument, you already should take the hint you’re probably on some bullshit.
  • More on bipartisanship: After Jim Acosta was given the ol’ Vaudeville Hook, Alexander questioned Trump on why he was pitting Americans against one another. To which Trump asked back—and I am not making this up—”What are you—trying to be him?” He was referring to Acosta, of course. Even after what just happened, it was stunning. For the record, Pres. Trump gave a dodgy “they’re soft on crime” answer and suggested the results of the election would have a “very positive impact.” So, um, yay togetherness!
  • If the Mueller investigation is unfair to the country and it’s costing millions of dollars, why doesn’t Trump just end it? I’m posting the whole question here, because the President sure didn’t answer it convincingly.
  • On voter suppression: “I’ll give you ‘voter suppression’: Take a look at the CNN polls, how inaccurate they were. That’s called ‘voter suppression’.” Um, what?
  • On the individual mandate: You know, I could tell you what he said, but do you have any confidence that, regardless of how people feel about the individual mandate, Republicans have a plan in mind which will allow them to keep premiums down and cover preexisting conditions? Neither do I.
  • When all questions by women of color are “stupid” or “racist”: Speaking of three-card Monte, here’s a shell game within the shell game in which you get to pick which one is the most flagrantly dog-whistle-y. PBS NewsHour’s Yamiche Alcindor asked Trump about whether his claim to be a “nationalist” has emboldened “white nationalists” here and abroad. Trump said it’s a “racist” question. Putting aside the notion held by many that racism implies power and Trump therefore has no idea what he’s talking about in this regard, it’s a legitimate question. Trump pivoted to his overwhelming support from African-American voters—a fabrication, at any rate—but his lack of an appropriate response betrays his complicity on this issue.
  • More on denigrating black female reporters: While the dialog with Alcindor was the only such interaction with an African-American female reporter during the press conference, it’s not his only recent unflattering characterization herein. In response to a question by CNN’s Abby Phillip about whether he appointed Matthew Whitaker as acting Attorney General, he called her query “stupid” and opined that she asks “a lot of stupid questions.” As for April Ryan, Trump recently referred to her as a “loser” and someone “who doesn’t know what she’s doing.” If these comments were isolated incidents, one might be able to give Trump the benefit of the doubt. In such close proximity to one another and based on his track record, though, Trump deserves no such consideration. He’s attacking these women of color because he has a problem with being challenged by strong females and because it’s red meat to throw at his base.
  • Other odds and ends:
  1. Trump evidently can’t turn over his tax returns because he is under audit. This is complete and unmitigated bullshit.
  2. Trump likes Oprah. Even if she, too, is a loser.
  3. If anything is going to be done with DACA, it will apparently have to be dealt with in court. Whose fault is that? You guessed it: the Democrats.
  4. Trump claimed to have a lot of trouble understanding people from foreign news outlets. If there were anything to make him seem like more of the “ugly American,” well, this would be it.
  5. What did Trump learn from the midterm results? Seeing as he learned that “people like him” and that “people like the job he’s doing,” he obviously didn’t learn a damn thing.
  6. Will Mike Pence be Trump’s running mate in 2020? Yes. Glad that’s settled. Nice hardball question there.
  7. How will Trump push a pro-life agenda with a divided Congress? Like a mother trying to give birth, he’s just going to keep pushing—don’t you worry, evangelicals.
  8. Did China or Russia interfere in the election? The official report’s, as they say, in the mail.
  9. How can we enact a middle-class tax cut alongside the existing corporate/high-earner tax cut? With an “adjustment.” What kind of adjustment? Trump’s “not telling.” YOU HAVE NO IDEA. JUST SAY IT.
  10. Per “Two Corinthians” Trump, God plays a very big role in his life. He’s also a “great moral leader,” and he loves our country. On an unrelated note, a lightning bolt ripped through the ceiling during the press conference, narrowly missing Trump as he delivered his remarks.

Au revoir, Monsieur Sessions

Politics makes strange bedfellows. If you’re thinking how strange it is to be protesting the firing of Jeff bleeping Sessions, you’re not alone. Sessions’ aforementioned removal as AG in favor of Trump loyalist Matthew Whitaker—assuming he actually was fired and didn’t resign, though how would we know?—is not something that anyone feels bad about for Sessions’s sake. You make a deal with the Devil, and eventually, you expect to get burned, no? Given his profile as a notorious anti-drug dinosaur who infamously once professed that good people don’t use marijuana, some drug reform activism groups are even happy he’s gone.

Outside of this context, though, the larger partisan hostility toward Robert Mueller and his investigation matters. I’m not going to even get into whether Trump has the right to remove Sessions and replace him with someone like Whitaker who wasn’t confirmed by the Senate, or whether it matters if he was fired or if he quit. Honestly, these questions are above my ken as a citizen journalist.

If past statements are any indication, however, putting Whitaker in charge of the DOJ is suspect. The man didn’t exactly write the book on how to limit the scope of the Mueller investigation, but he did pen an opinion piece for Trump’s favorite news outlet on how it should be done. As with invalidating Jim Acosta’s White House press privileges (a move which has prompted another lawsuit against the Trump administration, mind you), such is a line the president should not cross, no matter what side of the aisle you’re on. As Americans, we should all be worried about the fate of the Mueller investigation as it comes to a head, and should implore our elected officials to safeguard the inquiry’s results. 

The ghost of the 2000 election

Oh, those hanging chads. It’s somehow comforting—and yet actually deeply, deeply disturbing—that not much has changed since the fracas surrounding the 2000 recount that captivated a nation and prompted cries of a “stolen” victory for George W. Bush. Then again, that Al Gore didn’t win his own state and that thousands of Florida Democrats voted for Bush puts a bit of a damper on pointing to these shenanigans and Ralph Nader as the only reasons why Gore lost. As with Hillary Clinton losing in 2016, alongside legitimate concerns about Russian meddling and James Comey’s untimely letter to Congress, it’s not as if strategic miscues or lack of enthusiasm about the Democratic candidate in question didn’t play a role.

Now that I’ve set the scene, let’s talk about 2018. There were a number of close races across the country this Election Day—some so close they still haven’t been certified or conceded. Depending on your views, some were either disappointments or godsends. If you were pulling for Beto O’Rourke in Texas, while you still should be encouraged, you were nonetheless dismayed to find that enough voters willingly re-elected Ted Cruz, famed annoyance and rumored Zodiac Killer. If you were pulling for Kyrsten Sinema in Arizona, meanwhile, you likely were over the moon once the race was finally called.

Of the key races not yet called at this writing, those in Florida and Georgia loom particularly large. In the Sunshine State, the candidates of both the race for U.S. Senate between Rick Scott (R) and Bill Nelson (D) and the race for governor between Ron DeSantis (R) and Andrew Gillum (D) are separated by less than half of 1%. Meanwhile, in the Peach State gubernatorial race, there are enough outstanding votes that Stacey Abrams (D) and her campaign are convinced they can force a runoff election based on the margin. 

In all three cases, despite the razor-thin vote disparities, Republicans have been quick to cry fraud or try to expedite certifying the results. Scott, with Trump throwing his own claim around wildly in support, has made accusations of electoral malfeasance without the evidence to back it up.

And this is just speaking about what has happened after the election. Leading up to the election, DeSantis caught flak for telling voters not to “monkey this up” by voting for Gillum, dog-whistling loud enough for racists across the Southeast to hear. Brian Kemp (R), meanwhile as Georgia Secretary of State, oversaw the purging of voters from rolls, the failure to process voter applications, and keeping voting machines locked up—all primarily at the expense of voters of color, a key Democratic constituency. 

Depending on how far back you wish to go, the antics of DeSantis, Kemp, and Scott are only the latest turn in a long-standing American tradition of voter suppression aimed at blacks. Carol Anderson, professor of African-American studies at Emory University, provides a concise but effective history of keeping blacks from the polls—by hook or by crook. We may no longer be threatening prospective voters of color with tar and feathers, but voter purges, closure of polling locations, and disenfranchisement of felons from being able to vote aren’t much of an improvement. This is 2018, after all. 

As Van Jones and others might insist, Kemp et al. can only win one way: by stealing. To put it another way, if these Republicans were convinced they had won legitimately, they wouldn’t need all the chicanery, subterfuge, and insinuations of impropriety. Even if they do prove to have the votes necessary to win, their conduct is a stain on the offices they have served or will serve.

Like it is with the White House’s revocation of Jim Acosta’s privileges following Trump’s press conference or the suspicious installation of Matthew Whitaker as head of the Department of Justice, the injustice here is such that it should, ahem, trump partisanship. Instead, our “winning is the only thing” mentality and emphasis on results over process all but ensures bipartisan inaction. 


Assuming a shell game is run fairly, the customer playing need only follow the correct shell amid all the movement. This itself might be a chore depending on how much and how fast the shells move. Going back to the Wikipedia entry on the shell game, though, there’s an important note about how, frequently, games of these sort are not on the up-and-up:

In practice, however, the shell game is notorious for its use by confidence tricksters who will typically rig the game using sleight of hand to move or hide the ball during play and replace it as required. Fraudulent shell games are also known for the use of psychological tricks to convince potential players of the legitimacy of the game – for example, by using shills or by allowing a player to win a few times before beginning the scam.

In other words, it’s a con. You’ve been following the wrong shell all along because the eyes deceive. In the context of President Donald Trump’s unbecoming behavior, his DOJ shakeup of questionable legitimacy, and the Republican Party’s stacking of the electoral deck, while all of these matters merit your justifiable outrage, they are yet a distraction from something else not even on the table. 

For one, shortly after the press conference, Trump issued a directive designed to halt asylum-seeking at our southern border. It’s a particularly problematic order, in that it appears to fundamentally misunderstand asylum law and makes it yet harder to apply for asylum than it already is. It’s also reactionary policy that overstates the dangers of the migrant caravan and illegal immigration in general, and further puts us out of step with international standards on safeguarding refugees/asylees.

This executive order comes on the heels of Trump’s stated desire to end birthright citizenship, another move which would be of dubious constitutional validity and subject to challenge in court by civil rights advocacy groups, not to mention having U.S. troops stationed at the border with Mexico. It’s easy to dismiss these as political stunts designed to fire up his base when you have no skin in the game, so to speak.

For immigrants and would-be applicants for asylum/visas, this rhetoric is more worrisome. Owing to our country’s poor track record of acting on behalf of vulnerable populations—I’ll bring our sordid history of intimidating voters of color and otherwise acting in official capacities to deny them their rights back up, in case you need reminding—this is more than simple hand-wringing based on the theoretical.

In the miasma and noise of a Republican agenda fueled by the views of FOX News talking heads, Koch-Brothers-funded legislative influence, obeisance to moneyed interests and religious conservatives, Tea Party railing against deficits, and Trump’s own prejudicial outlook, it’s legitimately hard to cut through all the bullshit and focus on what we can do as possible influencers. By now, the sense of fatigue is real, especially because when we act to counteract said agenda, there’s also half-hearted Democratic Party policies and media clickbait designed to offend around which to work. 

So, what’s the answer? Assuming my words are even that useful in this regard, I’m not sure. As noted, all of the above merits scrutiny, but we have our limitations. It may be useful to zero in on one or a handful of issues that arouse your personal political passions. Plus, if you can afford it, so many causes spearheaded by organizations devoted to the betterment of society deserve your donations, though throwing money at these problems does not automatically equate to solving them.

At the end of the day, though, what is abundantly clear after decades of failed policy initiatives is that tuning out is not a viable option if we want meaningful change. Indeed, people-powered solutions will be necessary if we are to fix our broken democracy—and there’s a lot to fix, at that. Recognize the shell game for what it is, but don’t refuse to play. Instead, change the game.
