As I have emphasized on this blog and as numerous other concerned members of the Resistance would offer, when something crazy is going on in national news and politics—which these days unfortunately seems to disproportionately involve President Donald Trump and his embarrassing conduct—it merits watching what is going on when Congress actually gets around to advancing and/or passing legislation through the House and Senate. To be sure, there have been a fair amount of distractions recently that have dominated headlines and have made this task more difficult. Probably the biggest topic on everybody’s minds was the President’s alleged use of the word “shithole” in describing countries like El Salvador, Haiti, and various African countries that are less savory as sources of immigrants than, say, Norway. I say “alleged” because several Republican lawmakers present for the meeting and DHS secretary Kirstjen Nielsen have denied that he used that word. But come on—you know they’re full of shit. Even with a distraction like this, there’s another layer of distraction built in. Yes, Trump used a bad word, but the more important notion is Trump insinuated that it would be better if we accepted people from a country where white people are the majority as opposed to countries where black or brown people are the majority. Never mind that Americans are more likely to immigrate to Norway than the other way around because people who live there enjoy a high standard of living, universal health care, and generally are among the happiest individuals on Earth. The implication was clear to those who understand Trump has basically been a white supremacist’s wet dream since he started running for office.

Otherwise, there were more salacious accounts involving Trump’s personal life, specifically that he was having an affair with then-porn star Stormy Daniels while he was married to Melania back in 2006, and that, so as to not undermine his political chances or damage his brand or what-have-you, his lawyer formed a shell company in 2016 to negotiate the payment of $130,000 so that she would not disclose details about their relationship. Even though Daniels apparently did tell a number of details about it back in 2011 when interviewed by In Touch Weekly magazine—including the revelation that Trump is obsessed with sharks and hates their shark-y guts. Not a particularly damning revelation, mind you, but just entertaining. Why we haven’t heard or likely won’t hear more about it is perhaps puzzling—Chris Cillizza of CNN surmises it is likely because Trump’s camp has denied any connection between Trump and Daniels, people don’t want to be involved with anything even tangentially related to porn (at least where prying eyes might see), that we’ve heard it all about Trump already, or all of the above—but regardless of the profile of this story, it seems like pretty reprehensible behavior on Trump’s part from a moral standpoint, and pretty ethically inexplicable from a legal standpoint if there wasn’t any legitimate reason for Daniels to be getting $130K (and why wasn’t it $150K—that’s a much nicer “round” number than $130K, no?).

On top of this, there was the drama involving the government shutdown, which wasn’t so much of a “distraction” given that there were real consequences for this happening, but the partisan squabbling it encouraged was realistically more theatrical than anything. Democrats expressed their concerns about the level of funding for the Children’s Health Insurance Program (CHIP) and for the level of protection for “Dreamers” under Deferred Action for Childhood Arrivals (DACA). Republicans were outright blaming the Democrats for this mess and used military pay as a bargaining chip, alleging that the Dems held these all-important monies for our uniformed men and women hostage. Donald Trump kept insisting that someone needs to pay for a border wall. All the while, fingers were being pointed in every direction—with most Americans pointing back at Congress for not being able to strike a deal or by tying the DACA issue to the budget resolution issue, even if Democratic, Republican, and independent voters alike broadly support an extension of DACA. In short, and after the fact, no one looks good as a result of this, and for all his past criticisms of President Obama in presiding over shutdowns, it looks especially bad for Trump now that he has encountered one in just a year or so since he began his tenure—and with both the House and Senate under GOP control, no less.

All this, and we haven’t even gotten to the #ReleaseTheMemo business that conservatives have had on the tip of their tongue of late! Congressional Republicans have been alluding to a memo in Devin Nunes’ possession that outlines Obama-era abuses of the Foreign Intelligence Surveillance Act (FISA) by the FBI and Department of Justice, specifically as it regards investigation into Russian influence in the 2016 presidential election. Worse than Watergate, they claim! It is with this final distraction that I’ll bring in a recent piece by Matt Taibbi of Rolling Stone for an excellent contextualization—as he is wont to provide—of this particular instance of click-bait news. Taibbi starts by saying what most reasonable observers have put forth: that if the memo is really as jaw-dropping as outspoken Republicans have made it out to be, then by all means, it should be released. At the same time, though, as Taibbi argues, if this material truly exonerates Donald Trump of any wrongdoing re Russia, why hasn’t the man himself released it? After all, Trump, um, is characteristically not afraid to share. From the article:

By all means, if the memo is important (although I doubt it) let’s let the public see it. But followers of this story should also remember that if this or any classified document somehow exculpates Donald Trump on any front, he’s had the power all along to declassify such information. Why Trump hasn’t done so on a number of these occasions has been one of the enduring mysteries of this affair. It’s given pause to even the most hardened Russiagate skeptics.

This includes people like former federal prosecutor Andrew McCarthy of the National Review. McCarthy has been highly critical of the Robert Mueller investigation, but has also repeatedly wondered why Trump is not lifting the veil on some of these documents. One of the few figures in the media to explore holes in Russiagate theories propagated by both sides, McCarthy had this to say in August:

“I can’t get past a nagging question: Why must we speculate about whether the Obama administration abusively exploited its foreign-intelligence-collection powers in order to spy on Donald Trump’s political campaign? After all, Trump is president now. If he was victimized, he’s in a position to tell us all about it.”

At the very least, it’s food for thought, and prompts Matt Taibbi to label the #ReleaseTheMemo fervor “curious and disingenuous at best.” (Also not helping this case: that this hashtag has been linked to Russian bots that have helped to get it trending on Twitter.) At the same time, Taibbi indicates that it’s not like individuals on both sides of the political aisle haven’t been working to obscure what the sources of their information on Russia may be. Already, given its history of attention-grabbing details like lurid tales of Russian prostitutes and “golden showers,” and the subsequent backlash it received for having the likes of Buzzfeed break the news unconfirmed, the Steele dossier, for one, has not necessarily been something the mainstream media wants to acknowledge as informative of the investigation into Trump’s affairs. In other words, there’s much confusion and misdirection about what people know and how they know it re Russia, and thus far, it has mostly amounted to nothing more than additional confusion and tedious back-and-forth accusation, as it did with the shutdown.

The main thrust of Taibbi’s article, meanwhile, and getting back to the notion of these events as distraction and theater, is that while all this political brinksmanship was going on, important legislation with serious implications was being passed, aided by Democrats crossing that proverbial aisle. The first, coincidentally, involves FISA. Specifically, the House and Senate passed an extension of Section 702 of the Act, which lets the U.S. government obtain the communications of foreign nationals outside the United States without a warrant. Per the language of the law, intelligence agencies are not permitted to target U.S. citizens or nationals, or to use the power of Section 702 to surveil individuals on American soil. Groups like the American Civil Liberties Union and other civil liberties-minded organizations, however, have expressed doubts about how this program may be used and abused. The ACLU, in particular, enumerates these charges concerning the deleterious effects of Sec. 702:

  1. Section 702 allows warrantless surveillance of people inside and outside the U.S.
  2. Despite the fact that the law is not supposed to be used to target Americans, the government has been doing just that for years.
  3. Information collected under Section 702 could be used against you, and you likely wouldn’t know.
  4. Section 702 is used to examine communications flowing in and out of the U.S. in bulk.
  5. Surveillance programs have been abused by the intelligence agencies.
  6. There is little that prevents Section 702 from being used against critics, activists, religious minorities, or communities of color.
  7. The program is not subject to any meaningful judicial oversight.
  8. The government has deliberately chosen to hide the impact of the program from the public.
  9. Section 702 surveillance chills freedom of speech and association.

There are more detailed explanations for each of these items on the ACLU page linked to above, but suffice it to say, there are legitimate concerns about how broadly Section 702 may be used to capture information that is relevant to “foreign intelligence”—a distinction that is subjective and seemingly intentionally vague—how this sensitive information may be stored in databases for undetermined lengths of time, how political or even personal enemies may be targeted by intelligence community members as an abuse of their privilege, how legal procedure may be circumvented in the name of “anti-terrorism” efforts, and how so few data have been made clear to interested parties regarding the surveillance of Americans and the usage of their online communications. Liberal or conservative, it creates trepidation on the part of the average telephone/mobile/Internet user-consumer, and perhaps worst of all, it feeds the narrative of the “deep state” on the right that undermines even the best-intentioned government actions. But, by all means, let’s have more conspiracy theories!

As Matt Taibbi submits, too, it may be patently self-defeating to reauthorize the “virtually limitless surveillance powers of this president” when many suspect him to be aided or compromised by Russia. Which makes it all the more frustrating—at least to me—that Democrats like Nancy Pelosi and Adam Schiff would vote for an extension of Section 702 of FISA when they have publicly expressed their doubts about Trump. Taibbi explains what is likely behind this “yes” vote from key House Dems:

This is a classic example of something that’s been axiomatic in Washington for ages: that both parties tend always to be interested in expanding executive power, no matter who’s in office or what the political situation. In this case, the principle of expanding presidential authority outweighed even concerns of abuses by the likes of Donald Trump.

Or, perhaps to put this another way, yes, let’s give the executive more power so we can exploit it when our party is in the White House. As tends to be the case in the world of politics, moral objections are relative to how many seats you control and whether or not your side is in the Oval Office.

The other piece of legislation which stands to get through the Senate, notably with the help of several Democrats, and which is equally if not more concerning, is the rolling-back of regulations provided for by the Dodd-Frank Wall Street Reform and Consumer Protection Act, already criticized for not going far enough to do either of its stated objectives. The list of Democratic co-sponsors to the so-called Economic Growth, Regulatory Relief and Consumer Protection Act, which was released on December 5 of last year, reads like a who’s who of irritatingly moderate Democrats. Michael Bennet. Joe Donnelly. Heidi Heitkamp. Tim Kaine. Angus King, who technically is an independent, but let’s give him, ahem, credit where credit is due. Joe Manchin. Claire McCaskill. Gary Peters. Jon Tester. Mark Warner. These are self-professed Dems from states like Colorado, Montana, Virginia, and West Virginia in which being a centrist on matters of regulation of business appears to be a self-preservation move more than anything. Unless, as Taibbi suggests, they were either tricked or wooed by lobbyists for the banks. Here’s what he had to say on the matter:

In another bizarre episode, at least ten Senate Democrats recently crossed the aisle to support a rollback of key provisions of the Dodd-Frank banking reform bill, the killing of which of course has long been a major policy goal of Trump’s. The Dodd-Frank bill story is particularly disturbing, because it signals a rare potential area of consensus amid the otherwise reassuringly dysfunctional three-headed monster that is the lunatic Trump, establishment Republicans, and Democrats.

The bill has been pitched as aid and regulatory relief to small banks and credit unions. Such groups are the widows and orphans of financial reform: nobody’s ever against helping them, which is why even giveaways to Wall Street behemoths are often dressed up as aid to regional bankers. The Dems who crossed the aisle to support the Dodd-Frank rollback bought into the lobbyist-flogged idea that Too-Big-To-Fail banks have too many punitive regulatory requirements, and moreover that “smaller” companies (i.e. firms with less than $10 billion in assets) should be exempt from the already watered-down Volcker rule, which prevents depository banks from gambling for their own accounts.

One of the main ideas behind the proposed bill, which passed the banking committee 16 to 7, is changing the definition of a “Too Big to Fail” institution from having $50 billion in assets to having $250 billion in assets. This quintupling of the size limit would mean a number of huge companies would now enjoy relaxed capital requirements and other benefits. Only about 10 companies would be left to face the more stringent rules.

Why is this a concern? Only because it would increase the risk of another financial meltdown like we had ten years ago. As Taibbi and others argue, de-concentrating financial power by breaking up the big banks and by forcing them to separate banking and investing (read: sanctioned gambling) activities helps to mitigate this risk. Besides, if you’ll recall, it was taxpayers who bore the brunt of the last recession, but absent more stringent rules to keep Wall Street and the financial industry in check, there’s no guarantee another crisis won’t manifest. And once more, we would be the ones called on to bail out the big companies who played fast and loose with our money—not the other way around.

As Taibbi frames this, this is Congress in a nutshell: they fight publicly over something that’s “irrelevant, inaccurate, or far from a resolution,” only to have a consensus group advance a bill that is highly important/relevant, but “unsexy” and unlikely to garner the same attention, or even the kind of attention it merits. For the liberal progressives among us, this is a decidedly poor modus operandi.


Even as distraction, the three-day “kerfuffle,” as Matt Taibbi called it, over the shutdown was particularly galling to many on the left because the Democrats made a deal without any real assurances from Republicans that voting on a new DREAM Act would be taken up in the near future. Oh, sure, Mitch McConnell swore there would be, but trusting Mitch McConnell is like the fabled frog trusting the scorpion not to sting it as they cross the river—the scorpion will sting because that’s its nature, and McConnell will back out of his promise because he, like our President, is a lying sack of shit. Of course, Chuck Schumer didn’t waste much time backing out of certain terms either—after initially indicating prior to the end of the shutdown that a border wall would be on the table as part of forthcoming negotiations, he apparently pulled a 180 and made it clear the wall was no longer on the table. Psych! Regardless, after Donald Trump and congressional Republicans were done lambasting the Democrats for causing the whole government shutdown, the relatively short duration of the shutdown dovetailed ever nicely into jabs from conservatives that the Dems “caved” on the issues at hand. Name-calling though it might be, it’s hard to disagree with this assessment. The fate of Dreamers and the wall are still sticking points, and once more, the can has merely been kicked down the road noting that this resolution is merely a temporary budget fix.

Not that this necessarily means a huge deal, but if Americans are disappointed and embarrassed by this particular episode in U.S. politics, you can just imagine what the world thinks of us—distractions and all. Zack Beauchamp, writing for Vox, researched this very topic, and was struck by one prevailing theme which emerged from the responses he received from international observers: that there is something profoundly wrong with the American political system. For those looking on in Canada, France, and even the United Kingdom, with whom there yet remains some sympathy for our backward ways, there is cause for both concern and vague deprecation. For less understanding authoritarian regimes and otherwise tightly-run states, there is outright glee that America’s government can descend into chaos so easily, and unfounded as the claims may be, the shutdown makes us look weak, suggesting to some that Western democracy is fundamentally flawed (hello, Chinese propaganda!) or that the shutdown is pure theater to distract from the Democrats’ conspiracy theories about Trump’s ties to Russia (hello, Russian propaganda!). All these reactions without having to mention golden showers, shitholes, or Stormy Daniels. Jeez—has it only been a year so far? It feels more like ten with all the nonsense that’s gone on heretofore.

To reiterate, though, this goes back to the notion of distraction. For all the blaming and finger-pointing that went on this past week, where consensus has been achieved, yet worse consequences stand to be realized. The extension of Section 702 of FISA, as noted, is concerning to liberals and libertarians alike, and the continued collective kowtowing of Congress to “Too Big to Fail” institutions and Wall Street alumni is seeming proof that both parties work first for their benefit, and get to our concerns if and when they have the time and wherewithal. If you think a three-day shutdown is bad, just wait until the next economic nosedive, something that arguably is less a question of if and more a question of when.

2017: Fake News, #MeToo, and Everything Else in Between

2017 looks poised to finish on a high note, at least economically speaking. The stock market in the United States is near a record high, likely buoyed by the GOP’s corporation-friendly tax cut that President Donald Trump signed into law. Reportedly, the holiday season saw an increase of 5% in sales, an increase of 3.7% from the same span in 2016. Winning, winning, winning. Aren’t you tired of winning so much, fellow Americans? Aren’t you glad Pres. Trump is making America great again? Never mind the notion that he may not have as much to do with the economy as he would lead you to believe. Also, maybe we shouldn’t mention that, according to the Centre for Economics and Business Research in London, England, China and India’s economies will surpass that of the U.S.’s by 2030. In other long-term news, meanwhile, productivity growth within America’s economy remains low, income inequality remains startlingly high, the federal debt continues to skyrocket, and the nation is gripped by an opioid dependency epidemic.

So, glass half empty or glass half full? How do you see these United States shaping up over the next few years and into the future? It likely depends on which side of the political or socioeconomic fence you live—and whether or not you stand to personally benefit from the policies the Trump administration and a Republican-led Congress aim to advance. Looking just at the GOP tax cuts, opponents of this policy shift have assailed it as a present for the super-wealthy and industry leaders at the expense of average Americans, and as a greasing of the slippery slope toward the erosion of Social Security, Medicare, and other social safety net programs. In other words, the advantages of this agenda would tend to be appreciated by the few rather than the many, and perhaps it is no wonder Trump’s approval ratings are languishing south of 40%, a historical low at this point in the presidency.

Perhaps it’s instructive to see where we’ve been to help gauge where we may be going in 2018, in 2020, and beyond. Let’s take a look back at some of the topics covered in 2017 on United States of Joe. Warning: we may have a bit more to say regarding our orange leader. US of J 2017 Review: This Time, It’s Personal—Because Our President Takes Everything Personally

Hey—did you realize Donald Trump won the 2016 presidential election? No? Let Trump himself tell you about it! In fact, let him tell you about how he won going away every time something goes wrong or the press challenges him on the quality of his performance as President. You know, even though he didn’t win going away—dude didn’t even win the popular vote. Of course, Trump being the stupid baby that he is, he would challenge the legitimacy of Hillary Clinton’s supremacy in the popular vote, a harbinger of a disturbing trend that continues to play out with the Tweeter-in-Chief. Hillary didn’t win the popular vote—it was massive fraud involving undocumented immigrants that illegitimately got her that small victory. There’s absolutely no credible evidence of this, mind you, and the bullshit voter fraud task force the White House commissioned hasn’t turned up anything either. Trump’s Inauguration crowds were bigger than Barack Obama’s. Don’t believe the visual evidence? That’s OK—Trump, Sean Spicer and Co. were simply offering “alternative facts.” Don’t care for CNN’s brand of reporting? No problem—it’s “fake news.” After all, the media isn’t to be trusted in the first place—it’s the enemy of the people. I’m sure you felt that deep down anyhow, though.

Donald Trump’s assault on the truth and on verifiable fact is unmistakable, and his attacks on the press, including his fetishistic obsession with CNN, are overstated. That said, it’s not as if American news media is blameless in this regard either. Even before Trump was elected President, the mainstream media was an unabashed enabler of his antics. With Buzzfeed’s release of the “Pee-Pee Papers,” a salacious and unauthenticated account of Russian prostitutes performing sex acts at Trump’s behest supposedly based on credible intelligence, and CNN retracting a story on a supposed connection between Anthony Scaramucci, whose tenure as White House Communications Director was remarkably short-lived, and Trump’s Russian ties, Trump suddenly appears more credible. In the push for ratings and clicks in an turbulent era for journalism, the rush of media outlets to meet the demand of consumers for up-to-date information is understandable, but this does not excuse sloppy, irresponsible reporting. For the sake of the institution as a whole, the U.S. news media must balance the need to generate revenue with the importance of upholding standards of journalistic integrity, and must stand together when Trump et al. would seek to undermine one among their ranks—or risk a more precipitous downfall.

Gorsuch: Silver Fox and Supreme Court Justice

One of the big concerns following the death of Antonin Scalia and prompting voters to think hard about voting strategically between Hillary Clinton and Donald Trump was the idea the next President would get to nominate Scalia’s successor. We would be remiss if we did not mention that Barack Obama, well in advance of his departure from the White House, had already tapped Merrick Garland, a fine candidate to fill Scalia’s void. Mitch McConnell a.k.a. Turtle McTurtleface and the other Republicans in the Senate, meanwhile, would not even entertain Obama’s choice, prompting their constituents to protest outside of their offices and chant “Do your job!” In other words, it was really a dick move on the GOP’s part, and a gamble that the party would win the 2016 presidential election so they could install Antonin Scalia 2.0. Trump’s upset electoral victory thus paved the way for Neil Gorsuch to ascend to the highest court in the United States.

Gorsuch, previously a U.S. Circuit Court Judge with a seat on the U.S. Court of Appeals for the Tenth Circuit, is eminently qualified in his own right. This didn’t seem to be a point of contention between leaders of the two parties. Still, coming off a situation in which a perfectly good candidate in Garland was blocked as a function of mere partisanship, it brought an added measure of scrutiny and tension to confirmation proceedings. The Democrats filibustered to prevent cloture and delay a confirmation vote. The Republicans countered by invoking the so-called “nuclear option,” effectively changing Senate rules whereby they could break the filibuster with a simple majority. By a 54-45 vote, Neil Gorsuch was confirmed as the latest Supreme Court Justice. The whole process ultimately revealed few interesting tidbits about Gorsuch, and more so demonstrated the ugliness of political brinksmanship that has become a hallmark of Congress in this day and age. And we wonder why average Americans are not more politically engaged.

The Trump Administration vs. the World

As a function of “making America great again,” Donald Trump apparently believes strongly in defense spending and letting the world know the United States is #1. After alternatively touting his desire to bring the country along a more isolationist track and vowing to “bomb the shit out of ISIS” on the campaign trail, Trump, well, sort of did both. In terms of shows of force, his administration was responsible for dropping the “mother of all bombs” on Afghanistan, as well as approving the launch of dozens of missiles into Syria, supposedly as retaliation for the Assad regime’s use of toxic gas on its own people. The latter, in particular, got the dander of his white nationalist supporters up, though as far as most kinder, gentler souls are concerned, the disappointment of a bunch of ethnocentric xenophobes is not all that much of a loss. Less talked-about, but perhaps no less significant, were other less successful operations across international lines. First of all, not long after Trump took office, there was a botched raid in Yemen that saw Navy SEAL Ryan Owens killed, and to date, little information has been offered on the attack that led to his death and by all appearances was ill-advised. And there was the massacre at a mosque in Syria outside Aleppo. According to U.S. officials, numerous al-Qaeda operatives were taken out by the strike in the town of Jinah, but activists and others on the ground there tell a different story, one of civilians attending religious services and being fired upon as they tried to flee the place of worship. Reportedly, at least 46 people were killed in the assault on the mosque, and the U.S. military was criticized by humanitarian groups for not doing its due diligence in assessing the target for the possibility of civilian casualties. Oh, well—they were Muslims and not Americans anyway. Whoops!

In terms of isolating itself from the international community, America has done that under Donald Trump—if for other reason than it has done to things to alienate that international community. There was the whole backing of out of the Paris climate accord thing, which is voluntary in the first place and thus mostly serves as a middle finger to those here and abroad who give a hoot about polluting and climate change. Even before apparent attacks on American diplomats there, Trump and his administration have reversed course on Cuba relative to an Obama-era thawing of frigid diplomatic relations, and the benefit of this 180 to either side merits questioning. They’ve taken a tough tone with Iran and accused the country of not meeting its end of the bargain with respect to the nuclear deal much hated by conservative Republicans, in apparent deference to the whims of Saudi Arabia. Trump and North Korean president Kim Jong-un have basically had a year-long war of words through television news media and social media, with the latter referring to the former as a “dotard.” (Essentially, he told our President he’s a senile moron. Thanks, Merriam-Webster!) The White House has resolved to move the U.S. embassy in Israel to Jerusalem and to acknowledge the city, contested as to its very boundaries, as the capital of Israel, prompting a United Nations resolution condemning the move. And this is all before we even get to the investigation into Trump, his transition team, his administration, and suspected ties to Russia. In short, if Donald Trump hasn’t pissed you off this year, you’re either one of his core supporters or have just run out of f**ks to give—and I’m not sure which one is worse.

Race to the Exit: The Trump Administration Story

Viewing some of Trump’s picks for Cabinet posts and various positions within the White House at length, it was a wonder for many to see who might be first to go or fail to even get confirmed. At least Andrew Puzder, then-CEO of CKE Restaurants, the parent of Carl’s Jr. and Hardee’s, had the decency to withdraw before the confirmation process was over; as potential Secretary of Labor, it was his employ of undocumented immigrants which was his undoing. Not giving less than half a shit about his employees and being opposed to raising the minimum wage? Nah, that was fine. In fact, it made him more than suitable for nomination in the era of Trump. Betsy DeVos, Ben Carson, Linda McMahon, Mick Mulvaney, Steve Mnuchin, Rick Perry, Tom Price, Scott Pruitt, Jeff Sessions—these are the kinds of individuals that Donald Trump, seemingly without irony, tapped for important government posts despite a lack of proficiency in their area of supposed expertise, a stated desire to abolish the very agency they were named to head, or both. Price ultimately resigned when information about his questionable spending of the government’s finances to suit his convenience came to light, and there have been whispers about the job security of Sessions and Rex Tillerson from time to time, but for the most part, the bulk of them still remain. And so much for draining the swamp—between Goldman Sachs and billionaires, this Cabinet is as marshy as they come.

As for other appointees and residual officeholders, there was yet more volatility to be had. Michael Flynn was National Security Adviser for all of about a month before getting canned, and currently, he’s facing repercussions after pleading guilty to lying to federal investigators. Not to be outdone, the aforementioned Anthony Scaramucci lasted a scant ten days before his sacking as White House Communications Director, and in that short time, he divested himself of business ties and ruined his marriage. Welcome to the team, Mooch—and don’t let the door hit you on your way out! His predecessor, Sean “Spicey” Spicer, made it to July before bowing out, but not before some hilarious cameos on Saturday Night Live featuring Melissa McCarthy as Spicer. Steve Bannon, the Skeleton King, made it to August before he was either fired or before he resigned—depending on who you ask. Sebastian Gorka also departed in August, and seeing as he didn’t do much but argue with the press in interviews anyway, I’m relatively sure he isn’t missed. Omarosa Manigault Newman is set to resign in January, and evidently is not afraid to tell all. In sum, people can’t get out of the Trump White House soon enough, and whether some vacancies will go unfilled or simply are taking forever to get filled, the hallmark of this administration is disarray and upheaval. And somehow Kellyanne Conway still has a job. Sorry—that’s the sound of my head hitting the wall. I’ll try to keep it down.

The Democrats Form a Killer Strategy to Win in 2018, 2020, and Be—Oh, Who Are We Kidding?

For a while, it was relatively quiet on the Democratic Party front following the election and even the Inauguration with the Dems licking their wounds. This is not to say, obviously, that nothing was going on behind the scenes. One event which seems fairly minor but reflects deep conflicts within the Democratic ranks was the election of a new Democratic National Committee chair to replace departing interim chair Donna Brazile, herself a replacement for Debbie Wasserman Schultz. Keith Ellison, a Bernie Sanders supporter and popular progressive Democrat, was the front-runner for the position early, but concerns about Ellison’s lack of obeisance to the positions of the DNC’s rich Jewish donors and the establishment wing of the party not wishing to cede too much control to the “Bernie-crats” among them led former Labor Secretary Tom Perez to enter the fray. In the end, the vote was close, but Perez carried the day. That the Obama-Hillary segment of the Democratic Party would expend so much energy on a position that is largely ceremonial and concerned with fundraising is telling, and signals that any progressive reform of the party will be slow in coming—if at all.

If there is any further doubt about this, look at how certain races played out outside of the presidential milieu. Sure, Democrats may point to more recent victories in the gubernatorial elections of New Jersey (Phil Murphy) and Virginia (Ralph Northam), as well as the special election to replace Jeff Sessions in Alabama (Doug Jones), but other losses appear indicative of the Dems’ failure to commit to a comprehensive, 50-state strategy, namely Jon Ossoff in Georgia, James Thompson in Kansas, and Rob Quist in Montana, who lost to Greg Gianforte, even after the latter beat up a reporter. Seriously. Elsewhere, Hillary Clinton, after a moment of repose, released a book in which she accepted full responsibility for losing a election she was largely expected to win. Kidding! She blamed Bernie Sanders, voters for not coming out more strongly for her, James Comey, and even the DNC. That last one seems particularly disingenuous, especially when considering that Donna Brazile herself had a book to release critical of Hillary and one which confirmed what many of us already knew: that Hill-Dawg and the Committee were in cahoots long before the primaries. The Democrats seem content to allow Donald Trump and the machinations of the Republican Party to dig the GOP into an electoral hole. For an electorate increasingly weary of the “We’re Not the Other One” line, though, this does not a strategy make, and without an obvious frontrunner for 2020, the Democratic Party’s presumed advantage could well be overstated. Such that, if Trump actually makes it that far, it’s not inconceivable to think he could be re-elected. Talk about a recurring nightmare.

The White Supremacists, They Come Bearing Tiki Torches

In 2017, I would’ve thought it crazy for a scene to play out like it did in Charlottesville, Virginia this past August. And yet, lo and behold, it did. Some 250 protestors, carrying kerosene-filled torches and rebelling against a perceived erosion of their heritage and history, marched on the University of Virginia campus, shouting epithets, vowing not to be “replaced,” and generally ready to start a ruckus over the planned removal of a statue honoring Confederate general Robert E. Lee. The next day, though, if not as frightening in terms of the imagery, was worse in terms of the outcome. Protestors arrived carrying nationalist banners clubs, guns, and shields. Counter-protestors were also on hand to “greet” the white supremacists, the anti-fascists among them armed as well. It was not long before violence broke out, and by the time the police intervened, there already were injuries to tally. The worst of it all, though, were the fatalities. Heather Heyer, a counter-protestor, was killed as a result of a man deliberately plowing into people, and two state troopers, H. Jay Cullen and Berke M.M. Bates, died in a separate helicopter crash. In terms of senseless violence and loss, the Charlottesville riots seem to epitomize the very concept.

The apparent surge in white nationalist leanings following the election of Donald Trump is disturbing in its own right, but by the same token, so too is it unsettling that people would condone attacks against their ranks so readily. Some people who reject any set of principles that resembles Nazism believe violence to suppress hateful rhetoric is justified. Such is the belief of various antifa groups, and this where the debate of the movement’s merits comes into play. Though anti-fascists like those who don the mark of the Black Bloc don’t actually have much to do with traditional liberalism, their association with the left threatens the credibility of true liberal and progressive groups, and nullifies the bargaining power that these individuals have over the deficient worldviews they oppose. Two wrongs don’t make a right, and violence as a tool to suppress violence does not serve its intended purpose.

Congress vs. Everyday Americans: F**k Your Health Care, and F**k Your Income Inequality

Per President Trump, the Affordable Care Act, also affectionately known as “ObamaCare,” is a total disaster. Republican leaders likewise have been decrying the ACA for some time now, painting it as an unwanted intrusion of the federal government in the health care industry. Never mind that a significant portion of red-state voters depend on the provisions of the Affordable Care Act to be able to pay for medically necessary services, and that a sizable subset of America would actually like to see the nation move to a single-payer/Medicare-for-all model. Trump and a GOP Congress had a lot riding on a repeal of the Affordable Care Act and replacing it, though owing to the notion the devil is in the details, that Republicans tried to rush legislation through the House and the Senate with little idea of what was in it was telling that it probably wasn’t something they would want to share with their constituents. In the end, John McCain’s “no” vote on a “skinny” repeal of ObamaCare turned out to be pivotal in the measure’s failure to pass. Trump would later issue an executive order that would broadly task the government with working on ways to improve competition, prices, and quality of care, though it faced criticisms for how it essentially opened a backdoor for the destabilization of ACA marketplaces by taking younger, healthier consumers of the equation. Yet more significant could be the planned ending of cost-sharing subsidy payments to insurers that would likely mean higher prices for the consumer. Whatever the case, Trump and the GOP haven’t killed the Affordable Care Act, despite their boasts—they’ve only repealed the individual mandate aspect of the law. Of course, this doesn’t mean the Republicans are done coming for affordable health care. Far from it, in all likelihood.

Where Trump et al. found greater success—to our detriment, it should be stressed—is in the passage and signing of their tax reform bill. Once again, the knowledge of its contents prior to voting among lawmakers was questionable, but ultimately, by relatively slim margins in the House and Senate, what many have referred to as the “GOP Tax Scam” cleared Congress. Make no mistake: this is not good news for average Americans. Any benefits to be enjoyed in the short term are outweighed by how the wealthiest among us and corporations will experience that much more of a boon, with long-term consequences to the national debt and minimal rewards to be trickled down to the rank-and-file. In short, it’s class warfare, and potentially a troubling herald of future attempts to screw with Medicare, Social Security, and other entitlement programs—and the worst part is most of us seem to know it. One can only hope that Republicans will face their own consequences in forthcoming elections. It’s not a great consolation, but at this point, it’s the best we’ve got.

Some Protests Get Lost in the Shouting/Tweeting; Others Succeed Beyond Expectations

Even before Colin Kaepernick, there were player protests and refusals to stand at attention for the playing of the National Anthem at professional sporting events. Not long after the start of the NFL season, however, the continued kneeling, sitting, staying in the locker room, or raising of fists raised the ire of one President Donald Trump who, while apparently not busy playing golf or signing disastrous legislation into law, started a fracas about players refusing to stand during the Star-Spangled Banner, suggesting they should be suspended or outright released for their disrespect of the flag and of those who have served and died for our country. Trump also cited the NFL’s declining ratings and ticket sales as a direct impact of the players kneeling. While it’s possible reactions to player protests may be a factor in these downturns, this overlooks other persistent issues facing professional sports in general: declines in traditional television viewership among younger adults, high costs of premium sports channel packages, the prevalence of injuries and concerns about traumatic brain injuries, the steep price tag for attending games in person, and the mediocrity of play of any number of teams. All the while, the original thrust of Kaepernick’s protest—to raise awareness of the unfair treatment of people of color at the hands of police and other institutions—seemed to get lost in the discussion of who was protesting, which teams issued ultimatums about standing and which did not, and why people weren’t watching now. So much for fighting racial injustice. Better luck in 2018, people of color.

In perhaps a surprising turn of events, though, and possibly a watershed moment in the fights for gender equality and for standing up for victims of sexual assault and harassment, movie producer Harvey Weinstein’s exposure as a habitual offender of sexual misconduct, if not outright rape, opened the floodgates for other accusations, admissions, allegations, and denials. Hollywood has apparently borne the brunt of the revelations inspired by the #MeToo movement, with any number of projects shelved or cancelled as a result of men’s misdeeds, but the political realm also has seen its share of high-profile figures caught in the spotlight. Al Franken was forced to resign from his seat in the U.S. Senate after numerous women accused him of impropriety. John Conyers, another congressional Democrat, resigned too in the wake of a veritable mountain of allegations. Roy Moore didn’t abandon his political aspirations even after the likes of Mitch McConnell and Paul Ryan suggested he should step aside, but he also didn’t win as a Republican in Alabama. And then there’s maybe the biggest fish of them all: none other than Donald Trump. That Trump hasn’t been brought down by his own accusations—or for any other wrongdoing, for that matter—is somewhat deflating. Then again, maybe it’s only a matter of time. As with members of the GOP losing in 2018 and 2020, once more, we can only hope.

  • Meryl Streep famously put Donald Trump on blast at the Golden Globes. Predictably, this invited jeers from Trump supporters who felt “limousine liberals” like herself should “stay in their lane.” You may not like that Streep has a platform in this manner, but she still is an American, and that means not only is she entitled to say what she wants given the opportunity, but as she and others might see it, she has a civic duty to speak out when someone who ostensibly represents us, the people, does so in a destructive way. Kudos, Ms. Streep. I look forward to your acceptance speech at the forthcoming Golden Globes. Come on—you know it’s coming.
  • Bill Maher more or less engaged in a conversation with Sam Harris about how Islam is a deficient religion—though both men notably have their issues with organized religion, so take this for what it’s worth. In a separate chat with Sen. Ben Sasse of Nebraska, when jokingly asked by the senator if he would work in the fields of Nebraska, Maher referred to himself as a “house n****r.” For an educated guy, Maher is kind of a dickish moron.
  • Bernie Sanders and Ted Cruz had a health care debate on CNN. Why? Why not! At any rate, it was better than the Republican Party debates from last primary season.
  • In perhaps a glaring example of where we are as a nation in 2017, our President revealed he did not know who Frederick Douglass is—though Trump being Trump, tried to play it off like he did. Also, Kellyanne Conway continued to speak words that sounded like actual thoughts, declaring herself a “feminist” who apparently doesn’t know the meaning of the word, and elsewhere suggesting microwaves can be turned into cameras and be used to spy on us. Hmm—it appears my nose is bleeding. Or maybe that’s just my brain liquefying from these comments. Carry on, please.
  • In international news, Canada moved closer to legalizing marijuana, with a target date of Canada Day, 2018. In the States? Jeff Sessions the Racist Dinosaur and others like him talk about how weed is a drug for “bad people.” So, if you’re keeping score at home: cannabis :: bad; alcohol, tobacco, and firearms—things that are way more deadly than cannabis :: good. Well, at least we’ve got our priorities straight.
  • A handful of inmates were executed in Alabama, essentially because the state had a bunch of drugs used in lethal injection at its disposal set to expire, so—what the hell!—might as well use them! Pardon me for waxing philosophical as this moment, but the death penalty is state-sponsored murder. It is revenge for the sake of revenge, and way too often (and too late), it has ended the lives of those whose guilt would be proven false with new evidence and advances in forensic science. It should be abolished. Thank you. I’ll get down from my soapbox now.
  • James Comey was fired from his post as FBI director. This was in no way politically or personally motivated and in no way related to the investigation into Donald Trump, his finances, and any collusion with or other connections to Russia involving him or his surrogates. Right.
  • In Florida, the Grieving Families Act was signed into law, allowing women who have had miscarriages to obtain a “certificate of nonviable birth” for their fetus. So it’s about providing solace to women and their families? No, not really. At heart, it’s an end-around about abortion that seeks to specify when life begins and potentially heralds future attempts to chip away at women’s reproductive rights. Not to mention it connotes the idea that women who lose or terminate their pregnancies should only feel grief, when really, it can be a complex mix of emotions. As long as men are making decisions on the behalf of their female constituents about what they can and can’t do with their bodies, we’ll continue to see policies like this. Keep your eyes peeled.
  • Dana Loesch released a fiery video about the NRA and how it is “freedom’s last stand.” In other exciting gun news, a guy shot up a church in Sutherland Springs, Texas and killed a bunch of people. Let freedom ring, eh?
  • White nationalists apparently love Tucker Carlson because he question the merits of all immigration—legal or not. Carlson, like Bill Maher, is kind of a douche.
  • Venezuela held a sham election “won” by Nicolas Maduro. Maduro identifies with socialism. Socialism, therefore, is bad, and Bernie Sanders is the devil. Are you following this logic? If it makes sense to you, um, you’re probably not the intended audience for this blog, but thanks for reading anyway.
  • Catalonia had a vote to declare independence from Spain. The Spanish government, well, didn’t like that too much. The result was a violent crackdown against pro-independence protests and a lot of international attention drawn to the situation, and in a recent vote, separatists won a slim majority after Spain ousted the previous Catalan government. Great job, Prime Minister Rajoy! You really screwed the Puigdemont on that one.
  • Joe Arpaio, a virulent racist and all-around ass-hat who held inmates in substandard conditions and profiled residents suspected of being undocumented immigrants as Maricopa County Sheriff in Arizona, was pardoned by President Trump. In other words, f**k off, Hispanics and Latinos.
  • Millennials can still be blamed for pretty much anything, depending on who you ask. The extinction of the dinosaurs? Oh, yeah—we did that shit.
  • Bitcoin continues to see wild swings in its valuation after the spike in the second half of the year which brought it to the national consciousness. Does this mean it’s inherently bad? Not necessarily. As with any emerging technology, there are ups and downs to be had with Bitcoin made more pronounced by its recent prominence. Are you behind the curve now, though, with respect to making big bucks off of a relatively small investment? Most definitely.
  • By installing Mick Mulvaney as the head of the Consumer Financial Protection Bureau, America moved one step closer to eliminating the one agency expressly devoted to protecting consumer interests as regards their finances and investment vehicles. Consumer advocacy—what a joke!
  • Speaking of one step closer, the powers-that-be edged the Doomsday Clock one tick nearer to midnight. Er, pop the champagne?

In advance of the coming year, as far as politics and current events are concerned, there are all kinds of things that may factor into predictions for 2018. Certainly, though, we would expect certain things to continue as they are. Our beloved President will undoubtedly keep Tweeting acrimonious barbs at anyone who runs afoul of him and making cheap concessions to his supporters, especially from the context of rallies that he shouldn’t be having while not on the campaign trail. A GOP-majority Congress will still try to pass off policy designed to primarily benefit its wealthy corporate and individual donors as a boon for the “American people.” Bitcoin will probably still see extreme volatility as to its price, if the bubble doesn’t burst outright. And don’t even get me started about America’s attention to environmental conservation. When Trump and his Republican cronies are repealing Obama-era protections on keeping mining waste out of clean water, reversing bans on the Keystone XL Pipeline going through Native American reservations, allowing for the use of lead ammunition in national parks, and greenlighting drilling for oil in wildlife refuges, you know we are not close to doing our part to combat deleterious climate change. These actions belie the seriousness of the problem, and stunt the progress which can’t be stopped regarding the transition to renewable energy sources away from fossil fuels. At a time when we need to do all we can to slow or reverse the damage we’ve done to our planet, standing still is going backward.

Sounds bad, huh? While there are yet more reasons to be concerned from an activism/human rights standpoint—the all-too-slow recovery from Hurricane Maria in Puerto Rico; the pervasive influence of money in politics and gerrymandering purely for political gain; the plight of immigrants, migrants, and refugees worldwide; and the repeated iterations of the travel ban (read: Muslim ban) jump to mind—there is yet for hope for those on the left, and perhaps even those on the right. You know, even if they don’t know any better. In the political sphere, in particular, the deficient policies advanced by Republicans could end up in an electoral backlash in 2018 and 2020. Granted, this does not mean that Democrats don’t need to be held to higher standards, and as bad as GOP leadership has been, that Bernie Sanders, an aging independent from Vermont, remains a more popular choice than most prominent Dems suggests not is entirely well with the Democratic Party either. Speaking of bad leadership, and depending on the contents of Robert Mueller’s investigation, President Donald Trump might also be in real trouble from an ethical/legal standpoint. While visions of impeachment and President Mike Pence aren’t all that inspiring, at this point, anyone seems better than President Pussy-Grabber. I mean, eventually, all the terrible shit Trump has said and done has to come back to him, right? Right?

In truth, I am not terribly optimistic about 2018. But I’m also not done resisting against those who compromise ethical and moral standards to enrich themselves at the expense of others. By this, I mean the people at the top who are willing to see everyday Americans struggle through hunger, poverty, sickness and even death to further their bottom line. For all the preoccupation about border security, crime, and terrorism for many prospective 2020 voters, the “rigged” system about which Trump offhandedly talks is a yet bigger worry, and the aforementioned climate crisis our Earth faces is potentially worst of all. This all sounds very old-hat and trite, but until we start making real progress on the various forms of inequality which plague our society, these aphorisms must be repeated and stressed. Accordingly, through all the trepidation we might feel, there is too much work to be done not to do it. It’s worth the effort. After all, it’s our very lives and livelihoods we’re fighting for.

Trump vs. Personal and Financial Accountability: The War Rages On

“What about Donald Trump?”

What began as a trickle of allegations of sexual impropriety against Harvey Weinstein and Alyssa Milano’s unwitting revival of a decade-old hashtag campaign has since crescendoed to a tidal wave of admissions of guilt, suspicions of wrongdoing, and canceled project releases, suspensions, and firings. The list is a growing one, an impressive collection of high-profile names that’s becoming too long to contain even for my purposes in a 3,000-to-4,000-word blog post. Ultimately, what seems most important about these revelations is that they are happening at all. Women and men are coming out of the proverbial shadows to explicitly name their assaulters/harassers, and late in 2017, some measure of accountability for the abusive actions of men in power appears to be being exacted. In this respect, the identities of the accusers and the accused do not seem to be the most critical aspect, especially as it concerns attempts by media outlets and publicists to paint the accuser as a deceiver, liar, Jezebel, or seductress. Civil rights activists hope the #MeToo campaign and other associated movements are indicative of a sea change, a watershed moment for sexual freedom and reproductive rights, or some other water-related metaphor for social progress.

The idea that the names are less important than their associated dirty deeds becomes complicated, however, when the accused are charged specifically with representing and protecting members of the very populations against which they are alleged to have sinned, if you will. Sen. Al Franken, a leader within a party broadly identified with ideals of inclusivity and empowerment of women and other minorities, recently apologized after being confronted by several women about inappropriately touching them—though he didn’t really explain what in particular he was apologizing for. Rep. John Conyers is under pressure from fellow Democrats to resign from his post after his own allegations of sexual misconduct and after announcing he would step down from his role as top Democrat on the House Judiciary Committee. And then there’s Roy Moore. Beyond questions of his fitness to serve the public in any capacity in an unbiased way—let’s not forget his erecting a monument to the Ten Commandments outside his courthouse as well as continuing to enforce Alabama’s ban on same-sex marriage despite it being deemed unconstitutional as Chief Justice of the Alabama Supreme Court—there’s the matter of several women accusing Moore of making unwanted sexual advances on them prior to the age of consent (16 in Alabama) and/or sexually assaulting them. And this man currently has a 50-50 shot of winning a ticket to the U.S. Senate seat from Alabama voters.

Herein, a pattern begins to emerge just among those alleged to have committed unthinkable acts within the political sphere. The obvious commonality is that these supposed perpetrators are male and hold more power than the women claiming to be their victims. (I say “supposed” and “claiming” under the premise that these men are innocent until proven guilty, but by the same token, I believe their accusers, so at least for my sake, this is largely a question of semantics.) What are not part of the pattern, it should be stressed, are the race of the would-be assailants—Franken and Moore are white, Conyers is black—or their party affiliations—Conyers and Franken are Democrats, Moore is running as a representative of the Republican Party. Owing specifically to the notion sexual deviancy is a nonpartisan issue—or at least should be—and is a hot-button topic at that, it should be relatively easy for other party members to call for their colleagues to resign or step aside. As noted, other Democrats in Congress and members of the Congressional Black Caucus have suggested that John Conyers resign. Meanwhile, Paul Ryan and Mitch McConnell, alongside other prominent Republicans, have urged Roy Moore to remove his name from consideration for the vacant Senate seat set to soon be decided via special election, or otherwise have distanced themselves from supporting his campaign. Apparently, that he was a birther, hates homosexuals and Muslims, has past ties to neo-Confederate and white nationalist groups, and lied about monies received from his nonprofit Christian legal organization is all OK, but going after young women amidst a groundswell of public support for outing sexual predators—whoa, draw the line!

Which brings us to Donald J. Trump. Before we even get to his seemingly sordid history with women, let’s acknowledge the fact that he has maintained his support for Roy Moore through the litany of allegations, in this regard deviating from key members of his own chosen party. To be fair, other politicians, chiefly fellow Alabamans, have defended Moore in their own right, participating in their share of character assassination of the purported victims of Moore’s misdeeds. Also, Steve Bannon is set to publicly stump for Moore in advance of the election, which should be as much of a red flag as anything, but the point here is that Trump isn’t alone in backing Roy Moore. Then again, when Mitch Mc-freaking-Connell won’t even get behind someone purely for political reasons, you know he or she must be pretty damn toxic. That prospective voters in Alabama are yet on the fence about him would be mind-boggling if not for the idea roughly half of Americans who came out to the polls this past November opted for someone as scandalous and unqualified as Trump. For those voters, morality was an afterthought next to the issue or issues that mattered most to them at the time they cast their ballot. Unless they were voting strategically to block Hillary the Neoliberal and the Democrats, which would be more forgivable if it didn’t play directly into the hands of the two-party system.

So, what possible sins of Donald “Two Corinthians” Trump’s are his supporters potentially forgiving or at least overlooking? You know, besides generally being a shitty human being? In the arena of sexual predation, allegedly, there’s a lot to forgive/overlook. At least 12 women have made accusations of unwanted physical contact, not to mention several women have cited his effective invasion of the dressing rooms of various Miss USA and Miss Teen USA pageants while the contestants were undressing or undressed. It would be one thing for Trump if it were merely his word against theirs, and even then, he is vastly outnumbered. Being the blowhard and entitled-feeling brat he is, however, we have everything short of an admission on these fronts. Regarding the allegations against him of undesired advances and physicality, Trump basically copped to being a repeat offender in the infamous leaked recording from 2005 where he boasts to Billy Bush, then of Access Hollywood fame, about being able to grab women “by the pussy” and being able to do so essentially because he’s rich and famous. As for the discussion of him being a voyeuristic perv, possibly involving underage women at that, Trump bragged about that, too. In 2005—wow, this was quite the banner year for “the Donald,” wasn’t it?—Trump uttered these words during an interview with Howard Stern, really playing to his predominantly-male audience:

I’ll go backstage before a show, and everyone’s getting dressed and ready and everything else. You know, no men are anywhere. And I’m allowed to go in because I’m the owner of the pageant. And therefore I’m inspecting it…. “Is everyone OK?” You know, they’re standing there with no clothes. And you see these incredible-looking women. And so I sort of get away with things like that.

“Sort of get away with things like that?” What does that even mean? Either you do or you don’t get away with it, and through a #MeToo lens, Donald Trump shouldn’t get away with anything. For a man that many would contend shouldn’t have been allowed to be President in the first place, it stands to reason that he, like Louis C.K. and others fallen from grace, should be removed from his current role, even if he is President of these United States. That is, just because he is POTUS doesn’t mean he is infallible.

President Trump said these things. He may not have been President when he said them, but he did say them. At least with respect to the Access Hollywood tape, though, and more recently, Trump has indicated his disbelief, however insincere or warped it may be, that the tape actually exists. Again, it would be one thing if Trump merely denied the existence of the tape to begin with, and that would make this denial at least plausible on his part. But Trump has publicly acknowledged the contents of the tape. Leaked in the weeks before the 2016 election, it prompted him to issue a hasty apology. That’s a matter of public record, too. He literally said, “I said it, I was wrong, and I apologize.” So, if the tape doesn’t exist or was “doctored” in some way, for what was he apologizing in the first place? If it was a sincere apology, first of all, it was a terrible one, because it involved one of his favorite strategies to attempt to mitigate his personal responsibility: pivoting to the misdeeds—real or imagined—of the Clintons or some other made-to-be-reprehensible figure. More likely, though, Trump’s apology was wholly insincere. Why do I say this? Because Trump never really apologizes or takes responsibility for anything. It’s been his way leading up to the presidency, so why should it change now? The man simply doubles down on his assertions, claiming he does not remember key details of events that reflect poorly on his character, attacking the credibility of sources that report these events (see also “fake news”), and pivoting once more to other subjects. Even if he is not an abuser—and that’s a big “if”—he sure fits the profile of the kinds of men who have been brought down for less in recent weeks.

When Donald Trump isn’t busy trying to make the incontrovertibly true false, he’s trying to do the opposite. Much as recent reports have indicated that Trump has waffled on the very existence of the tape that painted him as a pussy-grabber, apparently, the man is not done with the whole birther controversy. You know, the one where Trump and others have insinuated Barack Obama was born in another country and should have never been able to be President. According to Maggie Haberman and Jonathan Martin, writing for The New York Times, Trump has questioned the veracity of Obama’s birth certificate behind closed doors. In the same type of forum, Trump has also repeated his belief that widespread voter fraud led to his losing the popular vote. The problem with these notions is that they’re both patently false. Obama has long since released his birth records showing proof of his Hawaiian birth, and Trump has even publicly acknowledged Obama was born in this country—period. As for the whole voter fraud angle, there is no credible evidence to back up Trump’s theories. None. Zero. Zilch. Nada. Besides, in what would seem to be a telling turn of events, the commission authorized by Pres. Trump has not even convened in recent weeks, though this may simply be a function of it being sued over a dozen times because of lack of transparency and concerns about the privacy of voter information. Either way, it’s a big to-do about something that ultimately has no bearing on the outcome of the election—and seriously, we should get on that whole making-the-popular-vote-decide-the-election thing the law of the land.


All of this talk of personal accountability for Donald Trump and his—how shall we say this?—special relationship with the truth has been within the purview of easily verifiable and already-verified data. There’s a recording of Trump saying awful things about his physical contact with women. There are authenticated birth records that reveal Barack Obama is a natural-born citizen of the United States. There is no evidence that millions of people voted illegally on Hillary Clinton’s behalf. Such an operation to meddle with the results of the election would require a significant amount of organization and resources to effect. You know, the kind of organization and resources, say, a central government would be able to provide, maybe even a foreign power such as—oh, I don’t know—Russia. Wait a minute—that did happen, only it was Trump who was the intended recipient of such collusion! It is on the subject of Russian interference and ties, meanwhile, that we segue to discussion of things yet less transparent: that of matters financial for Trump and his administration.

Even before the election, scrutiny was levied upon the unknowns surrounding Donald Trump’s personal finances. Specifically, people wondered—and still do—what the contents of his latest tax returns might reveal. Sure, Trump has claimed that only the media wants to see his tax information. In fact, at various points, a majority of Americans have wanted him to release his returns, believing it to be important to them and/or how the President does his job. What’s more, the returns are only part of the conversation re Trump and his money. For one, there’s the matter of Trump failing to put his assets in a blind trust. Oh, Trump’s legal representation has gone through contortions in explaining how what he has done with his businesses constitutes such an arrangement, but unfortunately for them, it’s a bunch of hogwash. That the Trump family has still managed a high degree of involvement in Trump Organization affairs clearly points to this so-called “blind trust” as being neither blind nor trustworthy.

There’s also the matter of Trump’s umpteen trips to Mar-a-Lago and other Trump-owned properties. These trips cost money, particularly when considering the need to safeguard the President and secure a host of properties not optimized for ensuring Trump’s safety. While we are talking about particulars, we, the taxpayers, are the ones footing the bill. And the Trump clan is materially benefitting from this arrangement—every time the President takes his golf clubs out of his bag. Based on a 2016 estimate from the Government Accountability Office, just one trip to Mar-a-Lago costs about $3 million. Donald Trump has been President for less than a year, but in that time, has made trips to at least one of his properties on 34 weekends, as of November 22. That’s no small potatoes, and we thus have every right to wonder whether any decision the Trump administration is making is primarily for the family’s benefit. Recall the first iteration of the embattled travel ban, a thinly-veiled bit of prejudice. Conspicuously, the countries that were named in the ban were ones in which the Trump Organization held no properties. Coincidence? Hardly.

It is against this inconsiderate and reckless financial backdrop that I invoke the recent tumult surrounding the Consumer Financial Protection Bureau, for when Donald Trump isn’t busy enriching himself—and boy, has he been enriching himself at our expense for longer than he has been President—he’s been doing his part alongside his adopted Republican brethren to help other rich assholes like himself stay rich or otherwise unaccountable for their actions. (See also, “Republican tax reform.”) First, a little backdrop for the backdrop, the CFPB was authorized in 2010 with the passage of the Dodd-Frank Wall Street Reform and Consumer Protection Act, a piece of legislation designed to approve accountability for financial institutions and lenders following the financial crisis of 2007 to whenever-the-heck-analysts-want-to-claim-it-ended-despite-people-and-companies-still-trying-to-recover. Broadly speaking, the Bureau is devoted to empowering consumers to make financial choices that best serve their needs, enforcing existing regulations against predatory lenders and other institutions that break the law, and educating consumers and companies alike about their capabilities and responsibilities. Much of their work has focused on credit cards, mortgages, and student loans, the likes of which just happen to produce mountains of debt and keep millions of Americans in financial shackles.

And this is the organization Trump, professed man of the people, and his cronies want to dismantle. The CFPB has not been above controversy in its brief tenure, not the least of which involves its unique structure as an independent agency controlled by a single director, i.e. “who will watch the Watchmen?” As Bryce Covert (great name for an investigative journalist, by the by) writes for New Republic, however, the Consumer Financial Protection Bureau has been the one organization devoted solely to protecting financial consumers, and has produced tangible results, namely netting some $12 billion from the likes of Wells Fargo and other financial institutions as compensatory relief for Jane and John Q. Public. According to Covert, this is precisely why Trump and the GOP want to gut the agency. Despite Trump calling the CFPB heretofore a “total disaster,” (much like ObamaCare, but who knew people actually like keeping their health care!) and despite disputed acting director Mick Mulvaney labeling it a “sad, sick joke,” many would contest the assertions of its conservative Republican critics that the Bureau is bad for banks. As Covert and others would maintain, the big banks, in particular, seem to be doing just fine ten years removed from the financial crisis. That’s what makes the current legal battle over the CFPB’s directorship so critically important. Prior to his resignation, Richard Cordray named deputy director Leandra English as acting director, and English has maintained the language of Dodd-Frank specifies that she should automatically take over as director. Pres. Trump, meanwhile, has appointed Mulvaney, previously one of the conservative mob looking on at the CFPB from afar with pitchforks and torches. Not literal pitchforks and torches, mind you. After all, this is Washington, D.C. we’re talking about here, not Charlottesville, VA.

When it comes down to brass tacks, then, why is Bryce Covert so concerned about Mick Mulvaney taking the reins of the Consumer Financial Protection Bureau, and why should you be as well? Well, in a nutshell, because each and every appointment made by President Trump so far has been a deliberate attempt to undermine the purest applications of the underlying office. From the appearance of things, in fact, Donald Trump looks to be directly trolling the disapproving left, but to suggest such things would be giving him far too much credit. Just look at some of his nominees for key Cabinet positions. Betsy DeVos as Secretary of Education—despite having no experience with public education. Scott Pruitt as head of the EPA—after suing it umpteen times as Oklahoma Attorney General. Rick Perry as Secretary of the Department of Energy—an agency he wanted to dismantle while on the presidential campaign trail but the name of which he famously was too blockheaded to remember during one debate. Even Mick Mulvaney himself barely got through Senate confirmation hearings to name him director of the Office of Management and Budget. Mulvaney, a fervent Tea Partier, rode the GOP offshoot’s wave of success during Obama’s tenure to a seat in the U.S. House of Representatives for the state of South Carolina in 2010. Among his soaring achievements as a member of the House (sarcasm intended) are his involvement in voting in 2015 against a funding resolution which would have prevented a government shutdown, in significant part due to the resolution also funding Planned Parenthood, which he named as a “traffick[er] in pieces of dead children,” being a founding member of the ultra-conservative Freedom Caucus within the House ([INSERT EYE-ROLL EMOJI HERE]), and opposing the Affordable Care Act and gun control, two things many of his constituents need or want, even the Republicans. Thanks for nothing, Mick!

Between Donald Trump in the White House and Mick Mulvaney as acting director of the Consumer Financial Protection Bureau, there is little to inspire or warrant enthusiasm. Once more, we turn to the insights of Bryce Covert:

[Republicans] opposed the creation of the CFPB from the beginning, and are devoted to whittling away at it. They’ve pushed to weaken its independence and effectiveness by monkeying with its structure. The House passed the CHOICE Act in June, which would strip the CFPB of its authority to supervise, police, and examine financial institutions; bar it from overseeing payday loans; and let the president fire its director at whim.

Candidate Trump appeared ready to strike a different pose in office. On the campaign trail, he railed against “hedge fund guys.” He promised not to “let Wall Street get away with murder,” arguing that “Wall Street has caused tremendous problems for us.” It was all part of his supposedly populist message that he would stand up for those left behind by an elite-driven economy and Washington, D.C. Yet, now in office, he’s gone soft on banks. His administration has already loosened financial regulations, dropped a rule to rein in Wall Street bonuses, and allowed AIG to wriggle out of stricter rules to protect the economy if the insurance giant failed.

And he’s followed the rest of his party in attacking the CFPB. His budget zeroed out its funding completely and proposed other ways to significantly change it. His Treasury Department released a report arguing that the CFPB’s “unaccountable structure and unduly broad regulatory powers” have “hindered consumer choice and access to credit, limited innovation, and imposed undue compliance burdens, particularly on small institutions.” The Treasury also recommended that the president be able to fire the director, that its enforcement be slowed down, and that many of its supervisory powers be handed back to agencies that previously did barely anything to police financial firms.

If Mulvaney survives English’s court challenge, he would be able to bring much of that wish list to life. And there’s no reason to think he’d do anything different. He has outright stated, “I don’t like the fact that CFPB exists.” On Monday he got to work, saying all new regulations from the CFPB will be frozen for 30 days. If he remains the bureau’s leader, we can expect much, much more of the same.

OK, so here’s the thing: Mick Mulvaney is only the acting director. If Leandra English’s legal challenge fails to make an impact, though, who knows how long Mulvaney will be at the helm of the CFPB or if it will even last long enough to make the contested director’s seat a meaningful point of contention? Pres. Trump’s administration has been marked by discord and disorganization, a notion highlighted by his molasses-like filling of key government positions that does little to help serve his agenda, as makeshift as it is. Why wouldn’t he drag his feet on appointing a successor for a bureau he wants to delete in the first place? And why wouldn’t we anticipate more abandonment of existing investigations into misdeeds of the financial sector and relaxation of regulations all under the vague impression regulation kills businesses? To take a cue from Ms. Covert, why expect anything to get better until it gets much, much worse?

Accountability. Responsibility. Truth. Whether with respect to something as trivial as the size of one’s Inauguration crowd vis-à-vis that of the previous President or something as of paramount importance as the health of the nation’s economy, rest assured you will not get these virtues from Donald Trump and the gaggle of Republican yes-men and yes-women he has tapped to distract and dissuade from the real damage they are trying to do for the benefit of their corporate and otherwise wealthy benefactors. Putting Mick Mulvaney at the head of the CFPB in an apparent attempt to eviscerate the one truly consumer-oriented agency designed to safeguard everyday Americans’ finances only furthers this notion. Amid Trump’s culture war on the most sacred American values, the vast majority of us stand to lose. Whether his supporters fail to recognize this, or do and simply don’t care, is the only thing left to question.

Don’t Worry—The Republican Tax Plan Is Going to Suck

Death and taxes. As the saying goes, they’re the two inescapable facts of life on this Earth. And maybe glitter, too. I’ve heard it said glitter is the herpes of the arts and crafts world, and having been the victim of glitter’s stickiness in the past, I appreciate the analogy. There’s so much you could say about death and its inevitability, more than could fit in one post and not exactly the kind of topic I’d cover in a blog about current events and politics anyway. There’s less you could say about glitter. It’s shiny—yay? Taxation in the United States, meanwhile, is an issue off which we can reasonably bite and chew. Taxes, be they local, state, or federal, are almost always relevant in some way to our daily lives, but currently exceedingly so in light of a recent resolution narrowly passed by the House of Representatives that paves the way for a Republican-led Congress to try to jam a tax reform bill through the legislature. After the GOP’s failure to get an ill-crafted replacement of the Affordable Care Act through both the House and Senate, the pressure is on Mitch McConnell, Paul Ryan, and the rest of the party’s leaders to devise something that will find success and uphold a pledge of both theirs and President Donald Trump’s to lower taxes.

Back at the end of September, Trump and the “Big Six”—House Ways and Means chair Kevin Brady, National Economic Council director Gary Cohn, Senate Finance chair Orrin Hatch, Mitch McConnell, Treasury Secretary Steve Mnuchin, and Paul Ryan—unveiled a rough cut of what a Republican tax reform bill would look like. David Floyd, writing about the “Trump tax reform plan” under the Investopedia.com banner, offers a fairly good primer on what the forthcoming bill might look like. Among the salient points of agreement among the Big Six and made evident to reporting media:

For personal taxes

  • Three brackets: In what may seem as somewhat of a welcome change given the U.S. tax code is often derided as too complex and ridden with loopholes, a GOP tax bill is expected to reduce the number of tax brackets applicable to personal filers from seven brackets to just three: 12%, 25%, and 35%. Perhaps the most notable change herein would be the reduction of the top bracket from 39.6%, because, as with charges levied against the Republican plan for “repeal and replace,” the intimation is that the primary intent of this legislation is to give the wealthiest Americans a tax cut. Well, this aspect sure doesn’t help.
  • Higher standard deductions: From the looks of things, much higher. For current 2017 tax law, the standard deduction for single filers is $6,350, and $12,700 for married filing jointly. Under the proposed reform, the Single standard deduction would rise to $12,000 and the MFJ deduction would shoot up to $24,000. As for the Head of Household deduction, um, what Head of Household deduction? Seriously, though, the GOP tax plan doesn’t mention anything about it, which could presage an elimination of this option. Sorry, single parents—this is Trump’s family-oriented America now.
  • No additional standard deduction: A forthcoming reform bill is likely to eliminate the additional standard deduction (currently at $1,550) for single filers who are either 65+ years of age or blind. Sorry, old and blind people—this is Trump’s America now. The disabled and elderly don’t get priority.
  • No personal exemption: That apparent good news about your standard deduction? It stands to be tempered by the likelihood that the personal exemption will evaporate. That’s $4,050 which would suddenly become unavailable. Harsh, bruh.
  • Elimination of itemized deductions: Not all itemized deductions, but a number of them, particularly that applicable to deducting state and local taxes. Which would disproportionately affect filers in “blue” states, but that’s just a coincidence, right? Already, the dramatic increase for the standard deduction would be anticipated to reduce the number of couples/individuals making use of itemized deductions, which would only be useful if these individual deductions surpass the given standard deduction. Eliminating the so-called SALT deduction would, in all probability, further increase that trend.
  • Increasing the child tax credit: Increasing the child tax credit—what’s bad about that? Well, not much, from what I can tell, but this is probably a concession designed to make the legislation more palatable from a political standpoint. This is to say that the main reason this bill is being proposed by Republican leadership is most likely not related to concern for the average parent and his or her child/children.
  • Cutting the AMT and estate tax: Yeah, this is straight-up, good-for-the-wealthy-type shit right here, especially concerning the latter, which affects less than 1% of American estates and only those worth more than $5.5 million. The Trump Family, in particular, would benefit handsomely from a repeal of the estate tax. Yup, no conflicts of interest here—move it along, people. Nothing to see here.

For business taxes

  • Cutting the top corporate tax rate to 20%: Corporations, so onerously plagued by taxes that a number of them find ways to pay little to nothing in this regard, will apparently have this burden further reduced by the Trump/Big Six tax plan. Here’s the thing about this tax cut: the cost. Taxes collected are tax revenues, and with a drop in the highest corporate tax rate from 35% to 20%, the estimated cost to the United States is some $2 trillion over a decade. Trillion. With a T. It’s doubtful the brain trust behind the forthcoming bill will be able to find a plug that large to fill the void.
  • Establishing a top “pass-through” rate of 25%. With pass-through entities, such as sole proprietorships, partnerships, and S-corporations, owners pay based on personal tax rates. As with the intended shift on the top corporate tax rate, the reduction in the top rate for pass-through entities would be substantial, down from the aforementioned 39.6% highest bracket threshold. Under the guise of this bill, this reduction is meant to give a break to America’s small businesses. Not only would a majority of small business owners not benefit anyway under the proposed plan, making this—surprise!—a boon predominantly for wealthier business owners, but defining what organizations/what type of work qualifies for classification in this way was already cumbersome. Meaning the IRS, already besieged by cuts over the past few years, will likely have that much more trouble sifting through returns if this bill comes to pass. It’s OK, though—your refund will get to you eventually. We hope.
  • Establishing a “territorial system” for foreign-based revenues: This applies to multinational corporations, and would allow these businesses to be subject to taxation based on where the money was made, rather than be subject to U.S. taxation, including a 35% tax on overseas profits for American corporations when they bring them back home. This might actually be a good element of the reform, as a large consensus seems to favor this treatment for multinationals, arguing that it will improve the American corporate tax system and could potentially make U.S. firms more competitive with their foreign counterparts. As they say, though, the Devil is in the details, and thus far, the details have been decidedly murky. What would a minimum foreign tax to discourage revenue shifting look like, exactly? For a supposed low, one-time tax rate to bring existing foreign revenues ashore, what is the proposed rate? If multinational corporations don’t want to shift them to the United States, do they even have to pay the tax at all? I’m asking you, the reader, because I’m not sure the Republican brass in charge of crafting this legislation have really thought through all the implications.

I say the details have been murky on the territorial system, but as with the various awful iterations of the GOP health care bill that did not get passed, there is a lot that is unclear about this tax plan concocted by the Trump administration and Co. What income ranges will get assigned to which of the three proposed tax brackets? Will the deduction from 39.6% to 35% actually survive the drafting process given obvious tax breaks for the wealthiest Americans are unpopular with most of the population? What itemized deductions actually stand to be preserved by the Republican tax reform bill? How will abuses of the reduced top pass-through rate be curbed? And how exactly are we going to pay for these tax cuts? How exactly are we going to pay for these tax cuts? No, really—how the f**k are we going to pay for these tax cuts? I’m asking this three times because it’s important, and because a shortfall in tax revenue is to be expected relative to current rates, will this mean cuts in other areas to offset these losses? Also like with the health care bill voting process, it is doubtful that GOP lawmakers will have the time and wherewithal to read and comprehend what they’re potentially voting on—or much less be asked to. Keeping in mind the Republican Party’s penchant for legislative chicanery and desire for a victory regardless of the eventual fallout, anything less than full speed ahead is considered a liability for those who bleed Republican red. By this token, Trump and the Big Six probably hope their Republican Party underlings are as in the dark about this bill as we are.

As much as we don’t know about the fine details, however, and as accelerated a timeline under which the Republicans in Congress will aim to operate to keep as many people as unaware as possible, the broad strokes are enough to tell that the forthcoming tax reform legislation, like the deficient health care bills that preceded it, is something about which calling and writing one’s elected representatives merits the effort. Because this is legislation which is primarily designed to benefit wealthy business owners and other wealthy individuals—let’s not sugarcoat the matter. But don’t just take my word for it. John Komlos, professor emeritus of economics and economic history at the University of Munich, states outright that the GOP tax cuts would make the rich even richer. In an opinion piece appearing in PBS’s economic segment, “Making Sen$e,” Komlos argues that any theoretical gains to be enjoyed by members of the middle class from these revisions and cuts are easily outpaced by the windfalls to be realized by the most well-to-do. The professor explains:

Take a median household of two earners with an income of $59,000. The best estimate is that their after-tax income will increase by 1.2% or by $704. To be sure, that is nothing to scoff at. It is twice as much as their income gains during the previous 17 years but it is hardly enough to be a game changer for them. Their likelihood of affording college for their kids will not increase, for example. Their consumption will be not increase the economy’s aggregate demand appreciably either.

In contrast, the super-rich will become amazingly even richer. If the GOP had its way, the top tax rate would decline from 39.6 percent to 35 percent for a married couple earning more than $470,000. Take a typical CEO of a major corporation who earns, say $20 million. With a typical effective tax bill of 25.6 percent for someone in that position, their take home pay currently would be around $14.8 million. Under the new plan, the tax bill would decline by 4.6 percent, or roughly $900,000. However, according to the nonpartisan Tax Policy Center, the gain would be even more — roughly $1.2 million.

Either way, in this scenario the windfall would leave the CEO with disposable income of around $16 million. This would certainly be enough to buy some political influence. So, the tax cuts feed a vicious circle that lead from the windfall to political power and the ability to influence the public’s worldview and thereby gain further profits and additional power both political and economic.

Prof. Komlos sees the Trump tax plan as another version of Reaganomics and to be rightly derided as “voodoo economics.” As it has been a linchpin of conservative economic theory for some time, the central mechanism here is trickle-down theory, and experience has shown it doesn’t quite work as specified. From the Reagan tax cuts, we got a “$2 trillion increase in the government deficit and the hollowing out of the middle class,” earning us respectable but only incremental growth. The majority of growth experienced under George W. Bush prior to the Great Recession benefited the top 1%, and the deficit ballooned yet again. All this is an erosion of the middle class and its power, while income and wealth inequality widen, with the growing chasm threatening to swallow the bottom 99% whole. As for the idea the drop in corporate tax rates will stimulate growth, Komlos argues that what is limiting additional investments by American businesses is not burdensome taxation, but lack of demand for the product. No amount of lining the pockets of the wealthy can magically spur demand from the public.

John Komlos’s closing remarks strike an ominous tone, even if they leave the door open for something better:

At its core, the tax plan was made by the 1 percent for the 1 percent. Apparently greed has no limits. Make no mistake about it: this is nothing less than class warfare. And as Warren Buffett, the second richest man in America, so astutely recognized, “my class has won.” We were fooled by Reaganomics. We were fooled by George W. Bush tax cuts. Will the 1 percent fool us again? Or will Abraham Lincoln be proved was right, when he said that you can’t fool all of the people all of the time.

The hope, of course, is that the American people will realize how lopsided this bill is and will demand something fairer, not just in terms of the alignment of specific income brackets with specific percentages, but in terms of the distribution of wealth and power across the American economic spectrum. The major reservation, however, is that some distraction like terrorism or Hillary Clinton or the difficulties of daily life will come along to make too many of us ready to forfeit our bargaining power. History has repeated itself with the Republican presidents leading up to Barack Obama. It can easily repeat itself after the fact, change and hope aside.


Speaking of distractions, as is so often the case with Donald Trump, he and his Republican cronies have utilized their brand of misdirection to try to minimize public attention to how terrible their tax plan will be. At about the same time we were hearing that the resolution narrowly passed which would allow Republicans to fast-track tax reform legislation through Congress, our attention was diverted to concerns about the release of the JFK assassination files, of all things, as well as Trump’s blathering about Hillary Clinton and sales of uranium to Russia. These may very well be worth the scrutiny, mind you, but the timing of their release/publicizing functions to obscure the fact that wealthy people masquerading as authentic representatives of the American people are intent on catering to their wealthiest benefactors first, leaving the scraps for the rest of us. The intersection of Trump administration proceedings, Republican legislative machinations, and the rantings and ravings of a spoiled brat who was elected to be—but does not act like—the President creates a shell game by which all options are vaguely appealing, but the contents of one have the unique power to do quantifiable damage to our country and the balance of power within it. In this case, it’s the GOP-led Congress’s shell that covers their mad dash of an attempt to give the wealthiest Americans an unnecessary tax break, and to get a bill passed before we’re singing “Auld Lang Syne” to ring in 2018. This means that, following any elections individual states, counties, and municipalities may have this November, the timeline for voicing opposition to any proposed legislation will be slim.

Thus, even while indictments are being issued by Robert Mueller in the investigation into Donald Trump and his potential ties to Russia, the details of this whole Republican tax shebang will be critical to pursue in the coming days, weeks, and months. Particularly so we can find out what the hell, if anything, is being done to our 401(k) plans and their associated limits. The Republican tax plan is going to suck. It’s up to us to find out just how bad it will suck and which representatives/senators to contact and pressure in the hopes it won’t be passed.

You Can’t Work with Donald Trump

With all that is going on with recovery efforts after a barrage of hurricanes in the Caribbean and the Gulf of Mexico, and with a battle over the future of health care in the United States of America in its current iteration in the form of the Graham-Cassidy Bill causing divisions even within the Republican Party, it almost seems silly to be talking about whether or not players kneel during the National Anthem. Then again, man-child Donald Trump is our President, Twitter is readily available, and his base apparently values blind patriotism over most things, so here we are. Trump essentially picked a fight with those individuals who would protest by doing anything other than standing with hand over heart—and by proxy, started in with the entirety of the National Football League—even going as far as to call these would-be dissenters “sons of bitches” and suggesting they should be fired. The NFL, meanwhile, through statements released by commissioner Roger Goodell and various owners, as well as through on-field shows of solidarity including kneeling, sitting, locking arms, and even remaining in the locker room during the playing of the Anthem, took Trump to task for his divisive rhetoric. These sentiments echo those of a separate fight picked with Stephen Curry and the Golden State Warriors of the National Basketball Association regarding whether or not he and they would honor the invitation to the White House customarily afforded to the champions of their sport. After it became apparent Curry and the Warriors would not be attending, Trump assailed them on Twitter and disinvited them—you know, despite the idea they already said they weren’t going. YOU CAN’T QUIT—YOU’RE FIRED! DO YOU HEAR ME? YOU’RE FIRED!

What was especially significant about this turn of events regarding the NFL’s repudiation of Donald Trump’s off-color language is that admonishment came not only from those players who assumed the distinction of being the target of the President’s ire and their coaches, but from those individuals who had previously indicated their support for Trump during the presidential campaign. Rex Ryan, who appeared with Trump at one or more campaign stops in New York state (Ryan previously coached both the New York Jets and the Buffalo Bills) and is now an analyst in ESPN’s employ, indicated he was “pissed off” by Trump’s comments and that he “did not sign up for” the kind of shenanigans in which Trump was engaging. This line of discussion, however, prompted some curious reactions on social media and even from his fellow on-air personalities (for example, see Randy Moss’s face when hearing Ryan reveal he voted for Donald Trump). A number of critics highlighted the notion that Rex Ryan evidently signed up for a man leading the country who has denigrated Asians, the disabled, environmentalists, the LGBT community, members of his own party, Mexicans, Muslims, veterans, and women—but calling football players a name was where he drew the line? Especially when, based on their size, these players are relatively more capable of defending themselves?

Psychologically speaking, it is perhaps unsurprising that Rex Ryan would react in this manner to the hissy-fit President Trump threw over players kneeling during the playing of the National Anthem. Tough talk and rhetoric is all well and good—until someone starts talking about you or someone you care about. Transcending the NFL and people who get paid to render their opinions on sports, however, Ryan is not the only person whose support for Donald Trump has ended with disillusion and distancing oneself from the so-called “leader” of the nation. After Trump’s response to Charlottesville and his condemnation of white supremacy were deemed to be—how shall we say this?—insufficient, his business councils were disbanded when CEOs couldn’t leave fast enough to separate themselves from his hate. When companies aren’t merely dissolving their working relationships with the Trump family, they are scaling back or outright terminating their business relationships with their litany of brands, in part thanks to targeted campaigns by members of the Resistance such as the #GrabYourWallet movement. As you might recall, months back, Donald Trump threw a whole different hissy-fit at Nordstrom for its announcement that it was phasing out his daughter Ivanka’s products from its stores—HIS DAUGHTER! WHAT A BUNCH OF MEANIES! Like with Rex Ryan and his support for Trump’s agenda up until the point of belittling rank-and-file football players for expressing their personal beliefs, all was well and good until Trump’s behavior threatened these organizations’ bottom line. As the saying goes, money talks and bullshit walks. In this instance, rather, people walk when Trump’s bullshit costs them money. After all, wouldn’t you?

If any of the above were isolated incidents, there wouldn’t be much here to discuss. Plenty of CEOs are dicks. Plenty of political leaders are dicks. Why shouldn’t Donald Trump—CEO-turned-President—be one of them? Ah, but Pres. Trump is not your average dick. The embodiment of rich white male privilege, Trump has never had to deal with meaningful consequences for his actions; even in business, some creditor or his daddy was there to bail him out. As the putative leader of the free world, meanwhile, Donald Trump is in a position that beckons diplomacy and restraint, two skills in which it is very clear at this point the man lacks proficiency because he has never had to hone them. Accordingly, for all those individuals who feel compelled to entertain Trump’s invitations to help him elaborate his policies, whether because of respect for the office of President of the United States or because they think they can manipulate him into serving their own interests, it is worth considering whether or not they truly understand what they’re getting themselves into.

Matthew Gertz, senior fellow at Media Matters for America, helps explain trying to work with Donald Trump at perhaps its most essential by keeping a running account of dealings with Trump in which #45 has publicly tried to debase or discredit the other party. Or, as Gertz, terms it, “If you try to work with Trump, he will humiliate you.” The list of instances of Trump throwing someone under the bus, getting into the driver’s seat, and backing over them again is far too long to regurgitate here. (If you really want to peruse Gertz’s ever-expanding Tweetstorm on the subject, suggested clicks are here and here.) That said, there are still, um, “highlights” to be had by which we can get a better sense of just how ill-fated any partnership with Donald Trump is owing to how self-aggrandizing this man is. Here is just a sampling of “working with Trump” looks like:

  • Trump passed over Mitt Romney for the office of Secretary of State, taking him out to dinner at a fancy restaurant and essentially having Romney publicly express his confidence in Trump as a repudiation of his earlier misgivings.
  • After Paul Ryan informed Trump he didn’t have the votes to make the GOP version of “repeal and replace” of the Affordable Care Act go through, Trump still wanted a vote. In subsequent talk of tax reform, Trump and his administration sought to take a more hands-on approach to the issue—and cut Ryan out of the picture in the process.
  • Trump regularly contradicted members of his administration and his aides regarding whether he had planned to fire James Comey as FBI director or whether he relied on the advice of deputy attorney general Rod Rosenstein before doing so.
  • Disregarding the advice of members of his business councils, Trump pulled out of the Paris climate agreement.
  • There was this time when everyone around Trump’s table was praising him out loud. Super creepy and weird.
  • Sean Spicer felt he had to resign over the appointment of Anthony Scaramucci as White House communications director—who lasted less than two weeks in that role.
  • Scaramucci, for that 10 days in his tenure, sold his business and had his marriage dissolve. Congratulations, Mooch!
  • Steve Bannon had his supposed role in helping Trump get elected diminished by Trump himself, suggesting Bannon came onto the campaign late. Bannon was gone shortly thereafter.
  • Jeff Sessions has basically eaten shit over the issue of Russia. Heaps of it.

And now there’s the whole NFL thing. People like Rex Ryan and Tom Brady and owners like Jerry Jones (Cowboys) and Robert Kraft (Patriots) lent Trump their support in advance of the election, and to satisfy his base and distract from other issues like health care and North Korea, Trump picked a fight over kneeling for the National Anthem, one which only serves to magnify the race problems that he and the League face. Thanks for your contributions, guys! Perhaps beyond being momentarily “pissed off” or “humiliated,” Ryan and Co. don’t really mind so much. After all, they got the President they wanted—or at least got the man they thought they wanted—and from the appearance of things, a conservative agenda for the White House is in place, the economy is humming along, and “America first” is our raison d’être. By the same token, however, perhaps there is just a twinkling of a spark of regret from these Trump backers that they helped create a monster. Probably not, but—what can I say?—I’m an optimist.


If non-politicians may be looking on at President Trump’s tenure with a sense of buyer’s remorse, what might congressional Republicans be experiencing? Their own embarrassment or shame? Such a question implies that these lawmakers can possess these emotions, or genuine feelings altogether. (Like Trump re Mexicans, I assume some members of the GOP in Congress are actually good people.) One individual who seems to lack the ability to express actual human sentiments is Mitch McConnell the Toad-Man, a guy who has overcome having a neck pouch to become Senate Majority Leader. Vis-à-vis Trump, McConnell has toed the party line on elements of the President’s agenda where their goals have aligned, trying to push through health care reform legislation even Donald Trump himself, the Grinch Who Stole the Election, could recognize was “mean,” exercising the “nuclear option” to require a simple majority to confirm conservative justice Neil Gorsuch for the Supreme Court, and arousing feminist ire around the country by silencing Elizabeth Warren on the Senate Floor for trying to read a letter from Coretta Scott King believed by Warren to be relevant to the appointment of Jeff Sessions as Attorney General.

In the latest chapter of the Donald Trump-Mitch McConnell relationship, the two men were perhaps strange bedfellows in the Republican Party primary in the special election for the vacant Senate seat created when Jeff Sessions was sworn in as Attorney General. Trump, McConnell, and most of the GOP establishment backed Luther Strange, an attorney and the interim junior senator from Alabama so appointed when Sessions became part of the Trump administration. Roy Moore, the challenger, is—well, Roy Moore is a special individual. Former Chief Justice of the Alabama Supreme Court, Moore’s greatest claims to fame—or, perhaps, infamy—are refusing to remove a statue of the Ten Commandments from outside his courthouse, thereby signaling his intentional blurring of the lines of separation between church and state, and his order to probate judges to refrain from issuing marriage licenses to gay and lesbian couples. So, yeah, more of that whole church-state business. For these incidents, Moore was twice removed from his role as Chief Justice by the Alabama Court of Judiciary, and based on his experience and penchant for inflammatory conduct and remarks, he was likely considered a liability by Republican leaders. Again, though, in the current political climate, Moore may just as well be seen as a godsend by many of his prospective constituents, and in the deep red state of Alabama, he looks to be in a great position to be an elected successor to Mr. Sessions despite his apparent craziness to a national audience. What’s more, despite McConnell’s signaling that he intends to work with Roy Moore should he be elected, many—including Moore himself—probably see his primary victory as a rebuke to McConnell’s brand of politics and a movement to oust centrist, ol’ fuddy-duddy Republicans like him.

Rich Lowry, writer for the New York Post, devoted a recent column to matters of Donald Trump, Mitch McConnell, Roy Moore, and the GOP’s handling of an evident insurgency within its own party. Hearkening back to the larger issue with which we began—the issue of working with Trump—as Lowry sees it, the party establishment still doesn’t understand how to do so, creating problems for both sides. Lowry explains:

The result in Alabama will render Trump even more up for grabs everywhere else. Is he going to simply move on and work with the congressional leadership on the next big priority, tax reform? Is he going to exercise the “Chuck and Nancy” option? Is he going to double down on his base and resume afflicting the comfortable of the GOP establishment as he did in the primaries? All of the above? Does he know?

Trump’s problem isn’t that he threw in with the establishment, as his most fervent supporters believe; it’s that he threw in with an establishment that had no idea how to process his victory and integrate populism into the traditional Republican agenda.

One of the many causes of the failure of ObamaCare repeal is that Republicans didn’t emphasize the economic interests of the working-class voters who propelled Trump to victory (and Trump showed little sign of caring about this himself). Out of the gate, tax reform looks to have a similar problem— the Trumpist element is supposed to be a middle-class tax cut, but it’s not obvious that it delivers one.

This gets to a fundamental failing of the populists. House Speaker Paul Ryan isn’t supposed to be the populist; Trump is. But the president and his backers haven’t even started to seriously think through what a workable populist platform is besides inveighing against internal party enemies, igniting cable TV-friendly controversies and overinvesting in symbolic measures like The Wall.

If the populists don’t like the results, they should take their own political project more seriously, if they are capable of it.

A success on taxes would provide some respite from the party’s internal dissension, yet the medium-term forecast has to be for more recrimination than governing. Whatever the core competency of the national Republican Party is at the moment, it certainly isn’t forging coherence or creating legislative achievements.

It’s no great surprise that Donald Trump and his cronies don’t have much of an idea about what they’re doing; concerning matters of domestic and foreign policy, Trump is a veritable Magic 8-Ball—shake him, wait a few moments, then shake again and see whether or not you get a different response. On the side of the Republican leadership’s veteran wing, however, this failure of party brass to respond to the needs of past voters and potential future voters is an ongoing concern somewhat mirrored in the battle for the soul of the Democratic Party between moderates and liberal progressives. The main difference, of course, is that, on the left, progressives seek to take centrist Dems to task for overvaluing corporate interests and not going far enough in seeking policy-based reforms, while Trumpist populists seem more concerned with the right’s refusal to embrace cultural elements of far-right conservatism. Germane to the Republican Party or not, it strikes the observer that Mitch McConnell and other GOP members of Congress greatly overestimated their ability to corral, handle, wrangle, or otherwise work with Donald Trump, much as they overconfidently thought they could ram the Graham-Cassidy Bill down our throats, underestimating we, the people, in the process. Thus, if you believe I believe that the likes of Paul Ryan and Mitch McConnell deserve a shred of sympathy for making a deal with the Devil, you would be sorely mistaken.

There’s no working with Donald Trump because he is a capricious, spoiled, man-baby with no room for other people’s considerations aside from his ego. Moreover, he is a known con man and liar who has exhibited a willingness to step on and over anyone who is an impediment to his desires, and for those who think that he will fulfill their own desires, they would be advised to wait for the other shoe to drop. Or, as Matthew Gertz might put it, wait to be humiliated.

Be Careful What You Wish For: President as CEO Edition

How many times have you heard the phrase “live each day like it’s your last?” It’s good advice, in theory. Certainly, you should be active in shaping your destiny and not waiting for things to happen to your benefit. Then again, taken to absurd extremes, this could be a dangerous mantra by which to live. At no point is it recommended that your drain your savings, spend it on alcohol, drugs, and other diversions, and throw the party to end all parties. Swimming pools full of liquor à la Kendrick Lamar. Sex with many anonymous partners. Fun, perhaps, yes, but not terribly prudent. If it seems like I’m a bit of a wet blanket in this regard, it’s only because, by all accounts, I am.

President Donald J. Trump, for his part, seems to subscribe to this way of thinking, or at least approaches running the country in this way. Risk the position of the Republican Party by insisting on a replacement to ObamaCare, an unpopular travel ban, a militaristic immigration policy and overall approach to criminal justice, and an expensive wall at the Mexican border, among other things? No big deal—Trump hasn’t been a very faithful member of the GOP, and basically ran his campaign without the full backing of the party’s leaders (in fact, that probably only helped him). Fire off crazy, unfounded remarks regularly on Twitter? Fine—the news media is happy with all the clicks and TV ratings it receives every time he makes his feelings known. Appeal to corporations and workers alike with a pro-business, anti-environment agenda? That’s OK—he’ll probably be dead by the time the worst effects of deleterious climate change hit (though at the rate he’s going, who knows).

More recently, however, it is the firing of FBI director James Comey that has people up in arms, particularly incensed about the decision of a man known for acting suddenly and capriciously. Now, was Mr. Comey a saint? Far from it, as evidenced by his rather brazen actions which directly influenced voters’ perceptions of the 2016 presidential race—which he testified as being absolutely sick about, because he had no intention of doing anything to sway the outcome. Sure, Jim, you’re really helping your credibility there. In fact, after Comey effectively threw hurdles in Hillary Clinton’s lane in the race for the presidency, many were calling for his head. You know, figuratively speaking. At least I think it was figuratively speaking. This past election sure dredged up some powerful feelings—and still continues to, if I might add.

Based on his guilt, then, James Comey doesn’t inspire a great deal of sympathy merely for losing his job. Where the outrage lies, meanwhile, is what the presumed motivations are for Trump deciding to fire Comey at this point in time. The White House has indicated it was because of Comey’s apparent bias and his lack of fairness in dealing with Hillary Clinton, among other things, but come on—nobody believes that. After all, why wait until May 2017 to make the determination to ax Comey if that were the case? Such reasoning is not only illogical, but it’s pretty damn insulting to our intelligence as readers, Tweeters, and viewers of the news.

No, the consensus opinion is that James Comey was fired because he was getting too close for comfort in his investigation of Donald Trump himself and other close associates. It is all but known that Trump and prominent members of his administration/campaign have direct financial ties to Russian oligarchs or had contact with Russian ambassadors prior to the election, and hacks of the Democratic National Committee’s and John Podesta’s E-mails raise serious concerns about whether or not Trump and his team were involved in an apparent plot to screw with American democratic proceedings and sway the election in his favor. In addition, viewed in the context of other firings within the Justice Department, namely those of Sally Yates and Preet Bharara, Comey’s removal is suspicious in that those individuals who have been involved with investigating Trump’s affairs have all been sent packing by the President. Sure, there’s no definitive proof these firings were all politically motivated—well, not yet, at least—but this trend raises one’s eyebrows. Heck, John McCain broke ranks with his fellow Republicans to express his disappointment in Comey proving to be a casualty of the Trump White House. When members of the GOP are publicly casting doubts about Trump’s motives, you know it’s a big deal.

Predictably, a number of his Cabinet members came to Pres. Trump’s defense, as I’m sure his fans on blogs, on Breitbart, and on talk radio did as well. The rationalization that stuck with me the most, though, was that of Nikki Haley, ambassador to the United Nations and, more recently, Donald Trump apologist. In an interview with George Stephanopoulos on his show This Week, Haley said that “[Trump] is the CEO of the country. He can hire and fire anyone he wants.” This is a striking assertion to me, not merely because Trump, as President of the United States, can’t just fire anyone he wants. A significant portion of Trump’s lasting appeal is his identity as a political outsider and a successful businessman (only one of the two is accurate), and in this regard, his presidency is almost an experiment of sorts in applying a business leadership model to a publicly-elected office. In talking with my close circle of friends about Donald Trump (spoiler alert: we’re generally not fond of him), we discussed how Americans who voted for the orange one may have been swayed by vague notions of wanting to see how the country could or would be run if it were handled like a corporation or other business. Given this frame of mind, Trump’s perceived success or failure and the future political prospects of other prominent Republicans could therefore be seen as a referendum on such an industry-focused approach.

Now well past the 100-day mark of Trump’s tenure, it’s worth considering whether or not more and more Americans who voted him into office might be suffering from a case of buyer’s remorse, not to mention contemplating just how well the Trump-as-CEO-President analogy fits. As John Cassidy, writing for The New Yorker, insists, if Donald Trump were a CEO, he’d probably be fired. To this end, and in his assessment of Trump’s tenure heretofore, Cassidy is pretty much unequivocal:

Donald Trump has built his political career on his reputation as a successful businessman, so it seems fair to assess his recent performance as President as if he were a C.E.O. running U.S.A., Inc. The report card isn’t pretty. Indeed, if Trump were the chief executive of a public company, the firm’s non-executive directors probably would have been huddled in a crisis meeting on Tuesday morning, deciding whether to issue him a pink slip.

In such a corporate scenario, the board members would likely decide they had no choice but to oust Trump to protect the reputation of the company and prevent further damage. During the past week, he has twice messed up monumentally, doing grave harm to his own credibility and undermining the country’s reputation around the world. And these were just his latest mistakes. During his four months in the corner office, Trump has repeatedly shown that he is patently unsuited for the position he holds, and he has also demonstrated a chronic inability to change the way he operates.

I would think more moderate Trump supporters and voters would be apt to concede that “the Donald” lacks the qualifications you might desire of a Commander-in-Chief, much in the way reluctant Hillary Clinton voters would likely concede their choice was—how can I put this delicately?—somewhat out of touch with working-class Americans. Those same people would also probably agree that flexibility and Donald Trump do not necessarily come part and parcel, though they might disagree to the extent this is a virtue or vice. For all those individuals who profess to want a negotiator who will work with members of both major political parties and knows how to compromise, there seems to be, if not an equivalent number of people, then a sufficiently vocal minority which believes the opposite: that refusal to compromise is an element of strong leadership, and that sticking to one’s proverbial guns is to be lauded, not decried.

In other words, John Cassidy would be remiss if he did not cite specific examples of how Donald Trump as POTUS and chief executive has failed. Thankfully, at least for his sake, he does not disappoint. Though I’m sure you can imagine which recent events top his list, here are the two big blockbusters that he cites to prove his point:

1. The firing of James Comey

We’ve addressed this in part, but Cassidy points out the incongruity in the public statements about why Comey was fired is a public relations disaster, and, though it almost certainly means nothing to Trump, he really hung Vice President Mike Pence out to dry by contradicting his account of why a vacancy at the head of the Federal Bureau of Investigation now exists. Trump’s ensuing Tweets that appear to be warning James Comey that he had better hope there were no tapes of their conversations only further the notion that he (Trump) is the kind of unstable person who you wouldn’t want caring for your pet goldfish, let alone a company or the United States of freaking America. I mean, to put it another way, um, blackmail tends to be frowned upon in our society.

2. The disclosure of classified information to Russian officials

At a bare minimum, this is a case of bad optics, but in a different country or perhaps even in a different era, Donald Trump would stand to be harangued or tarred-and-feathered—or worse—for what some might argue is tantamount to treason. We all know of Trump’s affinity for Vladimir Putin and other world leaders suspected of crimes against humanity. But seriously, bruh, this is Russia we’re talking about here. You know, the country responsible for hacking our election? As Cassidy puts it, running with the metaphor of America as a corporate entity (realistically speaking, it’s not much of a stretch), “Just how much damage Trump’s indiscretions have inflicted on the company isn’t yet known. But it’s clear that he was guilty of a serious breach of trust, and another stunning error of judgment.”

For most of Trump’s tenure as “CEO,” other executives within the company (high-ranking Republicans like Paul Ryan and Mitch McConnell) and its most bullish shareholders (Trump supporters) have been willing to roll with the punches, but as of late, #45’s antics have made even them skittish. Thinking in terms of the big picture, there is a clear element of risk here, and in terms of economic hazards, not just political danger. With the unpredictability of Donald Trump’s actions and the civil unrest that has accompanied his rise to power, both domestically-based and foreign-owned companies are less liable to seek to invest in our nation. The same goes for those individuals who would study or travel or work here. If not worried about their physical safety, the fear may well be for what is called, in business parlance, the going concern of the company, or its ability to remain in business for the foreseeable future. In the case of the United States of America, not only are concerns about our debt and our infrastructure more than justified, but the prospects of a climate catastrophe or world war don’t seem all that remote either. The ticking of the Doomsday Clock grows ever louder.

Donald Trump’s behavior of late has intensified talks of impeachment. In terms of potential impeachable offenses, the reported request made by Trump of James Comey to effectively look the other way on Michael Flynn looms especially large, as it points to a deliberate attempt to obstruct justice. Then again, for months, critics have been circling, highlighting, and putting a bright neon sticky note on Trump’s and his family’s refusal to divest or put Trump Organization assets in a blind trust, saying this alone is sufficient grounds for removal based on violation of the now-famous Emoluments Clause of the U.S. Constitution. Let it be stressed, though, that these calls for the deposition of Pres. Trump come with their own caveat. For one, cries for impeachment proceedings from the general public will likely need to be amplified by Congress, and the Republicans in the House and Senate don’t seem to give a serious enough shit to act to curb Trump’s wanton disregard for ethics, human decency, and said Constitution. Besides this, getting rid of Trump doesn’t mean that the leadership gets profoundly better based on who’s next in the line of succession. After Donald Trump—just to name a few—it’s Mike Pence (Vice President), followed by Paul Ryan (Speaker of the House), Orrin Hatch (President pro tem of the Senate), Rex Tillerson (Secretary of State), and Steven Mnuchin (Secretary of the Treasury). What a bunch of winners, eh? Hard to know which is slimier or more slippery than the next, and, yes, better than Trump, but as has been well established, that’s a low bar to clear.

President Trump’s reckless behavior, though, while it should be rightly admonished and while it forms the basis of much of John Cassidy’s analysis, doesn’t speak to the full scope of his ineffectiveness as CEO of the company-country. John Micklethwait, Bloomberg’s editor-in-chief, views things somewhat more holistically in terms of how well managed the White House is. As with Cassidy’s findings, meanwhile, the results are similarly unenthusiastic. Micklethwait’s piece is entitled “Would You Let Trump Run Your Company?” and hits on a number of the same themes that thus have been presented. The same antics that Cassidy enumerates are referenced herein, but the author quickly pivots to assessing the Trump presidency purely on its merits as a cohesive unit and the boss’s merits as a facilitator:

Behind this list of individual transgressions sit four larger failings: This CEO-in-chief has failed to get things done; he has failed to build a strong team, especially in domestic policy; he hasn’t dealt with conflicts of interest; and his communications is in shambles.

On the first count, you can basically spin the domestic policy wheel of fortune and pick an area where Trump and Co. have been unable to get substantive policy authored and enacted. The American Health Care Act, the GOP’s putative replacement for the Affordable Care Act, still has yet to be passed by both halves of Congress, and faces stern opposition not only from minority-party Democrats, but concerned constituents regardless of political affiliation. His proposed tax reform has yet to be even fully visualized. Ditto for his infrastructure plan, and to boot, several of his executive orders have (thankfully) been challenged in and stayed by the nation’s judiciary. So there’s that.

On the second count, Donald Trump is much further behind in filling needed posts than Barack Obama was at this point in his presidency. Even putting the drama with the quick-to-resign Michael Flynn aside, John Micklethwait points to a “whiff of cronyism” in the Trump administration ranks, capped off by positions of influence for Ivanka Trump and husband Jared Kushner despite their apparent lack of qualifications for their associated stature. As Micklethwait puts it: “There appears to be little structure in the White House. It’s more like a court than a company, with the king retiring to bed with a cheeseburger and spontaneously tweeting orders.”

On the third count, there’s Trump’s conflicts of interests, to which I’ve already alluded. Micklethwait highlights the contrast between how most—for lack of a better term—normal executives manage their personal investments next to those of their business, and how Trump, ever cavalier, has approached his affairs. In the author’s words once more:

In most businesses, this is something most incoming bosses deal with quickly and automatically. There’s an ethics policy, and you follow it. That policy usually has two levels: first, obeying the law; second, setting standards and following processes that avoid even the impression of any conflict. This second prohibitive level is crucial.

Again, and to make a long story short, the Trump family has failed this test, if you can even say that, because calling them failures implies they have at least nominally tried to comply with ethical and legal guidelines. They haven’t.

On the fourth and final count, there’s the communications aspect. Donald Trump is characteristically unpredictable, a quality he likely sees as a virtue because it keeps his would-be competitors guessing. Unfortunately, in terms of working with his so-called team, when figures like Nikki Haley and Rex Tillerson aren’t contradicting one another, Trump himself is Tweeting something that flies in the face of what Mike Pence or Sean Spicer or some other mouthpiece for the President says. Or he’s just flat-out lying, and unlike other CEOs who ultimately cop to their falsehoods and express some degree of contrition, Trump only doubles down on his assertions, and tries to bully or goad dissenters into silence. He’s not just merely falling short on this dimension—he’s helping create a dangerous world where facts are ignored or marginalized in favor of who has the loudest or sexiest argument.

In all respects, therefore, Pres. Trump is not proving an effective leader, and America is not “winning” nearly as much as he boasted we would because of it. In fact, we may be starting to lose outright. Stocks rebounded this past Thursday across major indexes, buoyed by strong economic data, but they had to rebound because uncertainty surrounding Donald Trump and whispers of impeachment sent the Dow Jones, for one, tumbling by more than 350 points. On one hand, two or three or four days does not a definitive economic trend make. Still, with a man in the White House whose penchant is unpredictability, that we might continue to see these individual “shocks” is reasonable, if not probable. When the fate of the markets is largely in the hands of reactionary investors, the question becomes how bumpy is too bumpy a ride before these shareholders want to get off.

In closing his op-ed, John Micklethwait offers these sentiments, essentially telling us it’s up to Republican Party leaders to decide whether or not it’s time to come get their boy Trump. You know, assuming he doesn’t suddenly become more presidential—and one is advised not to hold his or her breath to that end:

There is a semi-charitable explanation for much of this chaos. Trump does not have any experience as a CEO—at least in the sense that most of corporate America would recognize. One telling irony: Many of the banking executives now trying to curry favor with him would never have lent him money in the past. His skills were in dealmaking, rather than running a large organization. The core Trump company had barely 100 people. It’s possible that if he takes on some of the basic management lessons to do with structure, process, and delegation, then he may be able to run America. The question now is whether he has already made enough mistakes for the board to get rid of him. The closest thing America has to a board is the group of Republican senators who must decide what to investigate. Trump will hate the analogy, but at this moment, their leader, Senator McConnell, is his chairman—and the CEO has a lot of explaining to do.

In the lead-in to this post, I referred to Donald Trump leading the country like there’s no tomorrow. The GOP, too, has been playing a short-term game, doing what they can to approve the legislation and nominees they wish to have confirmed, even going as far as to use the “nuclear option”—changing Senate rules to overcome the power of filibuster. Otherwise, they have been performing a balancing act with their policy stances, eager not to alienate Trump supporters in possible bids for re-election. As the rocky road of Donald J. Trump as CEO of the US of A continues, however, how long will it be before they start to panic in their own right? For those who wanted a pro-business outsider from the private sector in the Oval Office, or simply someone who would advance a conservative Republican agenda, be careful what you wish for. You may not get the returns you’ve been seeking, and even worse, you may find your support for the CEO-President only serves to work against you after all.

Fix the Democratic Party or Start a New Party? The Progressive’s Conundrum

Who’s the most popular figure in American politics right now? Well, obviously, our fearless leader Donald Trump, right? Um, yeah, no. As of April 12, per Gallup, Trump’s approval rating sits at 41%, seemingly not all that much improved since hurling 59 Tomahawk missiles at Syria. In fact, since the start of his term, President Trump has gone from having essentially equal approval and disapproval ratings at a point in the mid-40s, to having his approval rating dip to a level of near-stasis around the 40-percent-mark and his disapproval rating escalate to a near-constant rating upward of 50%. So, yeah, it’s not that guy. For the sake of a contrast, Barack Obama finished his tenure with about a 60% approval rating—though let’s be real—as feelings of buyer’s remorse began to kick in shortly after Trump’s electoral victory, this figure was bound to be on the incline.

Given Congress’s depressed approval rating of late, you would be loath to thinking it would be a member of the House of Representatives or Senate either. Back to Gallup we go. Though hating on Congress is nothing new, it’s still fairly startling to see only one in five Americans giving our lawmakers a proverbial thumbs-up. Democratic respondents, likely frustrated with a Republican-controlled legislature running amok, report a scant 10% approval rating. Independents, likely believing both major parties, by and large, suck eggs, lie at the 20% national average. Even Republican respondent approval ratings of Congress are down; the current approval rating sits at 31%, notable after a 50% rating and seven-year high in February. Apparently, people don’t like it when you screw around with their health care—who knew!

Let’s back up a moment. Who is the most popular senator with his or her constituents? Wait a minute—could it be a certain senator from Vermont? Close! Patrick Leahy is second among senators in terms of approval from the residents he represents. Oh, wait—you meant the other senator from Vermont. Yup, the Granite State has quite the one-two punch in terms of positive vibes, and leading the country in terms of the most beloved senator in these United States is none other than Bernie Sanders, according to a recent Morning Consult poll. Both of Maine’s senators, Angus King (#5) and Susan Collins (#6), also ranked in the top ten, which is actually pretty well balanced between Democrats/independents and Republicans.

It should be noted that Sanders, while most-approved of within this poll and possessing the widest gap of approval to disapproval percentage, does not get the lowest disapproval rating overall; that honor goes to Brian Schatz of Hawaii (#8). For the sake of completion, lowest approval rating goes to Thom Tillis of North Carolina (39%), with Democrats Gary Peters of Michigan (39%), Robert Menendez of New Jersey (40%), and Catherine Cortez Masto of Nevada (42%), and Republican Dean Heller of Nevada (43%) rounding out the bottom five. Honorable mention goes to dishonorable Mitch McConnell (44%), Republican senator from Kentucky, the only person in the Senate to garner a higher disapproval rating (47%) than his or her approval rating. Congratulations, Mitch—you toad-faced heel.

Forget about mere popularity within the state of Vermont, though. Nationally speaking, Bernie Sanders, according to a FOX News poll dated March 15, enjoys a 61% approval rating, as opposed to a 32% approval rating. That’s significantly better than Donald Trump (44% favorable; 53 unfavorable) or even Mike Pence (47% favorable; 43% unfavorable). As Janice Williams, writing for Newsweek, frames these statistics, this kind of appeal might have been enough to give Bernie the W in a theoretical head-to-head matchup with Trump. Whether or not this is true is anyone’s guess, but regardless, these kinds of figures likely merit the Democratic Party’s attention.

While Sanders ran on the Democratic ticket in opposition to Hillary Clinton during the 2016 primaries, as a member of the Senate, he is, of course, an independent, and one of only two in the Senate alongside the aforementioned Angus King of Maine. As much as Bernie Sanders is keen to preserve his identity as an independent, though, the establishment wing of the Democratic Party appears content to keep him at arm’s length. Such is the complex dance between progressives who are sympathetic to the aims of the Democratic Party at large, especially as regards the Dems’ superior positions on matters of social policy, and mainstream Democrats who, generally speaking, want nothing to do with progressive candidates.

The well-publicized tension between the then-leadership of the Democratic National Committee and the Sanders presidential campaign provides perhaps the most salient example of this divide, but even after a failed attempt to keep Donald Trump out of the White House—an attempt which featured Bernie, upon suspension of his campaign, throwing his support behind Hillary Clinton, mind you—this same kind of tug-of-war informs Democrats’ backing of more liberal candidates, or lack thereof. This past Tuesday, the results of a special election to fill the vacancy of the House seat left vacant by Mike Pompeo’s appointment and confirmation as CIA director were surprisingly close given the setting: a Kansas district, which is situated in a deeply red state and which opted for Trump over Clinton by a 27% margin in the presidential election. Only seven percentage points separated the winner, Republican Ron Estes, from the runner-up, Democratic challenger James Thompson. Whether or not this one election heralds a more pronounced Democratic uprising in future elections is yet to be seen, but in another upcoming special election for a House seat in Georgia, Democratic supporters are licking their chops at the chance to grant victory to Jon Ossoff and send a message—however small—to President Trump and the GOP that their agenda is not approved of by a significant cross-section of the American population.

Give Republicans a run for their money in two red states? Democratic leadership must have invested a lot in both candidates, huh? Maybe—maybe not. In terms of Jon Ossoff, the candidate for the vacant House seat in Georgia, both the Democratic National Committee and the Democratic Congressional Campaign Committee (DCCC) have invested heavily in support of him, adding millions of dollars to the millions his campaign has raised, eager to spin the narrative of sticking it to Donald Trump. As for James Thompson, the progressive from Kansas? Eh, not so much. Sure, after the fact, the Democratic establishment added the closeness of the race between Estes and Thompson to this same anti-GOP, anti-Trump narrative. But during the campaign itself? Support for James Thompson was quantifiably lacking, despite his identification under the Democratic Party banner.

Michael Sainato, writing for Observer, explores the absenteeism of the DCCC and DNC in a piece that lays out the situation pretty succinctly from the title alone: “The DNC and DCCC Confirm They Won’t Support Progressive Candidates.” Here is a notable excerpt from the piece:

The Democratic establishment tried to appropriate Thompson’s success in the district as a testament that anti-Trump sentiments will translate to big wins for Democrats in the 2018 midterm elections. However, when pressed on why they failed to support Thompson, they dismissed criticisms for ignoring the race. The Huffington Post reported, “A DCCC official who spoke with The Huffington Post on Monday, however, argued that the party’s involvement would have been ‘extremely damaging’ to Thompson because it would have been used against him by Republicans, who have poured significant money into the race. Thompson has performed better than expected in the race because he stayed under the radar, the official added.” This claim makes little sense, especially given that Thompson’s Republican opponent portrayed him as an establishment Democrat anyways.

Rather than this special election representing an anomaly or misstep from the Democratic leadership, there’s a prevailing trend within the party’s establishment to select and support weak, centrist candidates who provide the party with opportunities to fundraise from corporate donors. This trend is symptomatic of a revolving door within the Democratic Party leadership, where party officials often sell out to work for Republican lobbying firms.

In this equation, Ossoff is that “centrist” candidate, which explains the disparity of support. The thinking from the leaders of the Democratic Party seems to be that a moderate Democrat is better than a Republican—even when courting big money from similar or even shady sources, or even “selling out” to working for Republican lobbying firms after the fact. A rose by any other name would still smell as sweet, and as progressives might argue, money in politics, whether at the behest of Dems or Republicans, is still a corrupting influence.

Thus, when it comes to progressive candidates and voters, there’s a dilemma concerning how and where they swear their allegiance in upcoming elections. By virtue of the Republican Party’s alliance with regressive conservative elements, and Trump’s own collusion with the far-right, the right side of the spectrum is a no-go. Supporting the Democratic Party, meanwhile, is problematic in its own right when its leadership doesn’t support them back, hews too close to center, and refuses to authentically embrace grassroots fundraising and organizing on a national level. Existing independent/third-party options are likewise less than savory owing to questionable organizational infrastructure and, as regards the Green Party and Libertarian Party specifically, figureheads in Jill Stein and Gary Johnson that are considered punchlines more so than viable presidential candidates. Broadly speaking, the current list of options for liberals is fraught with frustration.

In fact, if a recent article by Alex Roarty for McClatchy DC is any indication, liberals are “fuming” over the Democratic establishment’s reluctance to stick its neck out for anyone of a more progressive tint. Both Jim Dean of Democracy for America and members of our Our Revolution, an organization founded by former Bernie Sanders campaign staffers, are cited within the piece as reproaching the Democrats for their refusal to “wake up” and to stop ignoring districts they don’t think they can win because they are too “red.” Even James Thompson, the also-ran man from Kansas, was critical of the Democratic Party’s approach to his race, averring simply, “(DCCC) and DNC need to be doing a 50-state strategy.”

The DCCC and DNC spokespeople cited in Roarty’s article seemed to defend the lack of backing for Thompson by throwing up their hands and declaring the race “unwinnable,” a sentiment echoed all the way up to Committee chair Tom Perez himself. This is not the kind of talk that helps energize a party and recruit new members, though. First of all, yes, James Thompson lost, but only by seven percentage points, and with the likes of Mike Pence and Ted Cruz making appearances and Republican donors infusing money into the race against him in the final weeks and days when the final result seemed not so sure. In addition, and in the arena of the self-fulfilling prophecy, if you never try to make inroads in certain districts and areas of the country (e.g. Midwest, South), you are never going to win. It didn’t play well for Hillary Clinton to write off Trump supporters as “deplorables,” and it arguably doesn’t help the Democratic Party to ignore whole swaths of the United States of America.

In short, what are progressive liberals to do, especially when they see some of their most popular figures in Bernie Sanders, Elizabeth Warren, and Keith Ellison reduced to flunkies for the Clinton campaign and/or donation solicitors in the name of “party unity?” See, I think the Democratic leadership thinks we progressives are too stupid to notice that they are less concerned with what’s in our hearts and minds, and more concerned with what’s in our wallets and purses—or that they simply don’t care if we do notice. I believe, however, that progressives—young progressives, especially—are better at reading authenticity or its absence than today’s political leaders give them credit for, such that when Sanders or Warren threw their support behind Hillary for political reasons, or when they create a position in the DNC of deputy chair that is even more ceremonially meaningless than that of Perez’s role of chairperson, it rings hollow. As it should. Representative democracy doesn’t truly qualify as such unless constituents feel they are being represented by someone who embraces and exemplifies their values, and consistently, the Democratic Party brass had made it evident that they can’t or won’t go as far on matters of grassroots fundraising and policy than their more liberal supporters are asking them to.

As Jonathan H. Martin, professor of sociology at Framingham State University, and others of a progressive mindset are convinced, the answer to the question, “What do we do?” is “Form a new party.” As Martin depicts the situation, if people can’t coalesce around an existing party that has seemingly benefited from a Bernie bump of sorts, such as the Green Party, Justice Party, Socialist Alternative, or Vermont Progressive Party, then a new organization needs to be forged, with those who “feel the Bern” in mind. According to Prof. Martin, the two groups who are leading this charge, at least as of late February, are the Progressive Independent Party, which aims to be a coalition of the willing in terms of progressive, third-partiers, and others on the left, and the Draft Bernie for a People’s Party movement, which pretty much says what it entails up front.

Of the two, Jonathan Martin finds the latter more immediately appealing, for if someone as popular as Bernie Sanders were to break ranks and form a new party, polling indicates that not only does a sizable subset of the voting population desire a viable third party, but many Americans do want the kinds of bold reforms that a Sanders type proposes. Martin highlights both the likelihood that this vision could move forward with Bernie at the helm, and the ultimate choice that progressives face in the political uncertainty following the 2016 election, with the following ideas:

While recruiting Sanders for a “people’s party” may sound like a long-shot effort, his own statements indicate that he remains open to third party politics, and might well go that route if his work to reform the Democrats fails. However, if Bernie doesn’t eventually do this, the movement for a new party may go forward without him.

In any case, the DNC election and subsequent events should challenge both influential and ordinary progressives to ask themselves how long they will continue sailing on the U.S.S. Democrat. That ship is not headed toward the desired destination, nor is it even designed to go there. Moreover, in the wake of the 2016 election, it is a boat that appears to be rotting, drifting, and gradually sinking. Why not jump aboard a different vessel, one that really has the potential to get us where we urgently need to go?

For Bernie’s part, the man still seems unwilling to abandon ship, continually speaking in terms of reforming or rebuilding the Democratic Party in more democratic fashion, and eschewing the pleas of Jill Stein and Company to get on board with a third-party agenda. At the immediate moment, therefore, it seems more probable that a theoretical People’s Party will have to soldier on without their muse, though the alternative is certainly not impossible considering just how tiresome the Democratic establishment can be for the rest of us—and we’re not even interacting with them regularly like Bernie Sanders is. As for the rest of us? Perhaps we don’t quite see the Democrats as a rotting, drifting, sinking ship, but how many of us have one foot in a lifeboat—with some rope handy just in case we get the urge to kidnap Captain Sanders and hold him as our progressive prisoner? Presumably, such a political maneuver would be intended for 2020, as the 2018 midterms are just a year-and-change away, but to take a genuine shot at disrupting the duopoly held by the Democratic and Republican Parties, even that kind of mobilization needs to happen sooner than later. In other words, if liberals are thinking about bailing, they may need to make a decision fast with political waters rising.

Fix the Democratic Party or start a new party altogether? For progressives across the United States, it’s a conundrum, to be sure. This much, however, is clear: the Democratic Party, as it is, can’t function as a cohesive unit in the long term, and progressives backed by/composed of a coalition of young voters and working-class individuals either need to be invited to the table, or find a new restaurant altogether. What to do, what to do?

With Democrats Like These, Who Needs Republicans?

Though it’s been fairly quiet on the confirmation front lately (President Donald Trump has been repeatedly criticized for his—shall we say—dilatory commitment to filling vacancies in his Cabinet), even ex post facto, it can be educational to see how our U.S. senators voted on the 19 nominees thus confirmed. A particularly valuable resource in this regard is an interactive graphic from The New York Times authored by Wilson Andrews, Times graphics editor, that plots the confirmation vote records of each and every senator, sorted by most “no” votes to least.

On the Republican side, the results are disappointing, if not unsurprising. Of the 52 Republicans with a seat in the Senate, only four have registered at least one “no” vote: Lisa Murkowski (DeVos), John McCain, (Mulvaney), Rand Paul (Pompeo, Coats), and Susan Collins (DeVos, Pruitt). Aside from Andrew Puzder, who withdrew his name for consideration for the role of Secretary of Labor, and Betsy DeVos, Secretary of Education, who required Vice President Mike Pence to break a 50-50 tie and has been the only nominee to receive multiple “no” votes from Republicans, no one else has really been in doubt to pass confirmation proceedings. The only other candidates who have failed to garner even 55 votes are Mick Mulvaney (Office of Management and Budget), Jeff Sessions (Attorney General), Tom Price (Department of Health and Human Services), Scott Pruitt (Environmental Protection Agency), and Steven Mnuchin, the likes of which, either based on their past conduct, their conflicts upon conflicts of interest, or both, haven’t exactly distinguished themselves—well, at least not in the positive sense.

As for the Democrats and independents, the results are decidedly more varied. The top “no” voter in the Senate, tallying 17 of 19 nays, is Kirsten Gillibrand of New York, who is not really regarded as a progressive heroine, but has seemingly moved further left as she has gone along, and certainly more so than in her days in the House. Also high on the list are some of the more popular and well-regarded senators in terms of their principles—Cory Booker, Jeff Merkley, Bernie Sanders, and Elizabeth Warren, all of whom have issued 16 of 19 “no” votes. These senators and others who have voted no roughly two-thirds of the time—13 or more “no” votes, let’s say—comprise a minority even within the group of just Democratic and independent senators. Only 15 of this bloc of 48 senators have voted “no” 13+ times (31.25%), and that clip decreases to a scant 15% within the U.S. Senate at large. On one hand, that more Democrats are willing to break ranks is perhaps encouraging in terms of the desire to not merely rubberstamp or preemptively dismiss nominees along the path to confirmation. On the other hand, if you were looking for a unified front from the Dems, you can go ahead and keep looking, and moreover, the divide in votes may be indicative of a larger ideological divide within the Democratic Party.

Though a minority in its own right, a group of eight Democratic or independent senators has failed to record 10 or more “no” votes in 19 confirmation vote proceedings, with five of them failing to eclipse even six of 19, or a third of votes. These are the lowest of the low, literally speaking, regarding “no” votes:

“No” Votes: 4 (DeVos, Mulvaney, Price, Ross)

Joe Manchin, a professed Democrat, has cast as many “no” votes as Republican Senators who have voted “no” altogether during the confirmation process. As noted, that’s a bar that should be fairly easy to clear—and he hasn’t. The votes for Scott Pruitt and Rex Tillerson don’t come as that much of a surprise for Manchin, hailing from a state that is synonymous with coal, but the “yes” vote for Jeff Sessions is particularly egregious. Some are comparing Joe Manchin, based on his willingness to break from other Dems, to Joe Lieberman, a comparison which is not all that endearing. Though obviously a joke, it’s telling when the official Twitter feed for Full Frontal with Samantha Bee suggests Democrats oppose Manchin in the 2018 primaries with a lump of coal. Brutal, but not wholly undeserved.

Heidi Heitkamp, like Joe Manchin III, suffers the ignominy of voting “yes” on both Pruitt and Tillerson. Also like Manchin, she hails from a state in North Dakota of which fossil fuels make up a significant part of the economy, so not a huge shocker there, but still disappointing. That she would be so principled on nominees like Mick Mulvaney, Jeff Sessions, Tom Price, and Steven Mnuchin makes her positions on Scott Pruitt and Rex Tillerson all the more jarring. Either way, Heitkamp and Manchin are the only two Democrats to vote for both Pruitt and Tillerson, and the former, like the latter, should receive her due censure from progressives within the party.

Angus King (I-ME)

Angus King of Maine is one of two independents in the Senate, alongside a certain senator from the state of Vermont who gave Hillary Clinton a run for her money regarding the Democratic Party nomination. Like Bernie Sanders, he caucuses with the Democrats. Apparently, though, he doesn’t vote with them nearly as often as his counterpart. Certainly, the “yes” vote for Rex Tillerson is concerning, but his approval for the likes of Ben Carson and Rick Perry is also vaguely disconcerting. Mr. King, you may be independent and may caucus with the Dems, but you are no Bernie Sanders. Not even close.

Joe Donnelly (D-IN)

“No” Votes: 6 (DeVos, Mulvaney, Sessions, Price, Mnuchin, Tillerson; did not vote on Pruitt)

If you believe Joe Donnelly, he is a lawmaker committed to making life better for his fellow Hoosiers, and this includes working across the aisle when necessary. If you approach his statements and his voting record from a more pragmatic or even cynical viewpoint, though, you might say he capitulates to conservatives when he has to. As both a member of the House of Representatives and a U.S. Senator, Donnelly’s record has been marked by his being more moderate on both economic and social issues. While I respect that this likely has caused him stress in being the subject of attacks from both the left and the right, speaking as someone from the far-left, I and other progressive-minded individuals are looking for better than 6-for-19 on these confirmation votes. That would be fine in baseball, but Indiana does not have a major league team, and these matters are more important.

Mark Warner (D-VA)

“No” Votes: 6 (DeVos, Mulvaney, Sessions, Price, Pruitt, Mnuchin)

Mark Warner has the exact same voting record on Cabinet position confirmations as the aforementioned independent Angus King. That’s not an endorsement—nor should it be considered as such. Once again, the principled stance on Pruitt alongside a “yes” vote on Tillerson is an odd juxtaposition, and even casting votes in favor of Rick Perry or even Ryan Zinke raises the progressive brow. Warner, it should be noted, is the top Senate Democrat investigating ties between Russia and Trump, particularly in the arena of interference in the 2016 presidential election. That said, being recently spotted having a chat over wine with Rex Tillerson doesn’t exactly inspire confidence for Democratic supporters that his interests and party loyalty are all that pure. Mark Warner, you’re on notice.


Even for those Democratic senators who have cleared the low hurdle of six “no” votes, a few others have yet to garner double digits, putting their judgment in question, or, if nothing else, suggesting they may be too close to center to really inspire enthusiasm among younger members of the party base. The following senators, if not getting an explicit wag of the finger, are nonetheless worthy of a wary eye:

Claire McCaskill (D-MO)

“No” Votes: 7 (DeVos, Mulvaney, Sessions, Pruitt, Mnuchin, Tillerson, Carson; did not vote on Price)

You may have heard Claire McCaskill’s name in the news recently, when she called upon Jeff Sessions to recuse himself from any investigations into Russia and Trump, averring that she personally had never met Russian ambassador Sergey Kislyak—when, in fact, she totally had.  She also has recently been making a push to Bernie Sanders supporters in her bid for re-election—you know, despite endorsing Hillary Clinton early in the primaries and criticizing Sanders’ campaign at the time. These stories may say enough about the Democratic senator from Missouri, but her voting record alone on Trump’s Cabinet nominees should prompt criticism from the left.

Jon Tester (D-MT)

“No” Votes: 8 (DeVos, Mulvaney, Sessions, Price, Pruitt, Mnuchin, Tillerson, Pompeo)

As far as moderates go, Jon Tester is fairly well regarded among liberals based on a number of his votes in the Senate, as well as policy positions which have evolved and moved further left over time (e.g. same-sex marriage, Don’t-Ask-Don’t-Tell). A bleeding-heart liberal Tester is not, though, with his pro-gun stance, for instance, painting him as more of a “your grandpappy’s” kind of Dem than the “elitist liberals” that are always being decried in right-wing circles. At least on the gun issue, this is perhaps to be expected in a red state like Montana. Still, one might have liked to see more push-back on nominees like Wilbur Ross or even Linda McMahon given his past diatribes against the wealthy. You get a pass this time, Sen. Tester. This time.

Tim Kaine (D-VA)

“No” Votes: 9 (DeVos, Mulvaney, Sessions, Price, Pruitt, Mnuchin, Tillerson, Carson, Perry)

Tim Kaine’s presence on this short list means Virginia has two under-10 “no” vote senators to its name, the only such state to earn that distinction given two Democratic/independent senators. Kaine, as you’ll recall, was Hillary Clinton’s pick for vice president, and a way too “safe” one at that. He is the sort that is unlikely to generate much enthusiasm from even party loyalists, let alone a younger portion of the base looking for more conviction on important issues, such as free trade (like Clinton, Kaine has supported NAFTA and came late to his resolution against the Trans-Pacific Partnership) and regulation of the banking industry (proposals of his, while under the guise of being pro-regulation, have been criticized by progressive groups as being anything but). Tim Kaine may be a nice enough guy, but he was the wrong choice for Clinton’s presidential campaign, and may be symbolic of the “mainstream” wing of the Democratic Party that is keeping it from more enthusiastically embracing more liberal views.


To be fair, one might argue that “no” votes without much hope of dramatically altering the outcomes of these Cabinet nominees mean very little. In this regard, stances taken against potential office holders amount to little more than posturing. By the same token, however, for those who have registered more “yes” votes than “no” votes, perhaps these confirmation votes presage a deeper reluctance to embrace the Democratic Party as a whole, or at least magnify the effect of their senator’s centrism.

Where the rubber meets the road, so to speak, then, is with the looming vote to confirm Neil Gorsuch as the next Supreme Court justice. In a vacuum, Donald Trump’s choice of Gorsuch to fill the vacancy left by the passing of Antonin Scalia might not be so hotly contested by Democrats. As things in the political world have shaken out of late, though, there is additional context to consider. Republicans already had majorities in the House of Representatives and the Senate before the fateful events of November, and with Trump—a loose cannon if ever there were one—ascending to the highest office in the nation, the stakes are higher than ever for a party in the Democratic Party that is reeling from electoral defeats up and down the levels of government.

Of even higher relevance, meanwhile, is Merrick Garland’s stalled nomination for this same vacancy. As you’ll likely recall, Garland was tapped by President Barack Obama near the end of his tenure, which he was perfectly justified in doing. Effectually, Obama called conservative Republicans’ bluff, nominating the kind of jurist that appeals to those on both side of the political aisle, and thus requiring GOP lawmakers to all but in name concede their refusal to confirm or hear Merrick Garland was petty gamesmanship. Which, of course, they did. Mitch McConnell and Co. held their breath and waited for Obama’s second term to conclude, rejecting calls from their Democratic counterparts and their constituents alike to “do their jobs.”

With all this in mind, we return to the current kerfuffle over Neil Gorsuch. Whereas Trump’s various Cabinet picks have only needed a 51-vote majority to secure confirmation, the role of Supreme Court justice, because it is so vital and because it is a lifetime appointment, would require 60 votes as part of a procedural cloture vote to end debate and move on to the actual confirmation vote if Senate Democrats are determined to filibuster the nomination. So, how committed are the Dems and independents in the Senate to staving off the confirmation vote? Well, let’s just say they should have enough votes—a minimum of 41 would be required—to filibuster Gorsuch’s nomination. But it’s not exactly a safe margin, and fairly significantly, I feel, a few senators have either wavered on whether or not they will support a filibuster, or have outright indicated they are against this measure. Once again, Wilson Andrews and The New York Times, with the help of Audrey Carlsen, Alicia Parlapiano, and Jugal K. Patel, have devised another helpful graphic to help us sort out the positions for or against filibuster.

Undecided or Unclear: 2

Up for Re-election: 2 (Benjamin L. Cardin, Robert Menendez)

Ben Cardin and Bob Menendez are likely to vote against Neil Gorsuch in a final vote to determine if he is confirmed or not. Remember, though, we are talking about specifically pledging to support the 60-vote filibuster, and as of Tuesday, April 4, 4:30 P.M. EDT, their commitment was judged by the team at the Times to be undecided or unclear on that front. Cardin, for what it’s worth, has said he supports the filibuster on social media, and Menendez has apparently followed suit. Both senators are facing re-election in 2018, but that provides only slight plausibility as to why they would wait until Democrats were all but assured of having the necessary 41 votes given they do not really hail from strong red states. In short, and to be quite frank, it’s pretty cowardly of Ben Cardin and Bob Menendez to make their intentions known after the fact. The above-cited article from The Hill also name-checks Angus King, who, as we know, is an independent and has only managed a scant six “no” votes (and is up for re-election), as a late decider. As Democrats, however, you would expect better of Cardin and Menendez, both of whom have gone 12-for-19 in “no” votes, and as a progressive hailing from the state of New Jersey, I am severely disappointed in the latter.

Against Filibuster: 4

Up for Re-election in Solid Trump State: 3 (Joe Donnelly, Heidi Heitkamp, Joe Manchin III)

Not Up for Re-election: 1 (Michael Bennet)

Joe Manchin. Heidi Heitkamp. Joe Donnelly. We’ve heard these names before, haven’t we? Suddenly, their positions on Cabinet nominees, viewed through the lens of their opposition to the filibuster, make a lot of sense. All three are running for re-election in what are deemed “solid Trump states,” meaning Donald Trump carried them by more than five percentage points in the presidential election.

On one hand, I get that re-election in hostile territory, so to speak, stands to be difficult, and there are those of us who would be willing to accept a moderate Democrat who agrees with the party at least some of the time as opposed to a Republican who is more likely to promote a regressive political agenda. On the other hand, though, being, for all intents and purposes, light versions of Republicans arguably does little for the party and only helps depress turnout in elections, especially among independents and progressives. In this regard, the Dems who capitulate to conservative or even moneyed interests can be seen as conceding without making a concerted effort to expand their base among neglected demographic groups in their jurisdictions—playing politics in the short term and risking party support in the long term. In other words, the likes of Donnelly, Heitkamp and Manchin are playing not to lose rather than to win, and this same strategy as employed by Hillary Clinton and other Democrats only seems to be hurting the Democratic Party at the polls. Once again, speaking bluntly, Democratic leadership doesn’t seem to “get it.”

As for Michael Bennet, even for someone whose job is not immediately in danger, he has recognizably faced pressure from both the left and right regarding the filibuster. If Jon Tester, a senator in a red state up for re-election can support the filibuster, however, I submit Bennet (10-of-19 “no votes”) could have, too. Way to ride that center rail, Mike.


The Senate Republicans are expected to exercise the so-called “nuclear option,” essentially rewriting the rules so that 51 votes can advance proceedings to the actual confirmation vote. So, why bother with a filibuster? Democrats and others on the left would insist that this is more than warranted for the GOP’s refusal to hear Merrick Garland, and besides, with a president whose ethical conflicts are barely disguised as such, and who many contend is too unhinged to serve in his present role, there are those who call on Senate Dems to demand Trump release his tax returns at a minimum before considering Neil Gorsuch for the vacancy in the Supreme Court. Then again, Republicans would say that the Democrats “started it,” after rewriting Senate confirmation rules for executive and judicial nominees in their own right in 2013.  Is all fair in love, war, and politics, or do two wrongs not make a right? I guess it depends on what side of the fence you’re on, honestly.

Even if the Republicans “go nuclear,” as President Agent Orange would have it, resisting the confirmation of Gorsuch and other picks until that point based on the merit of held ideals would convey to voters that the Democrats are willing to fight for their constituents and for what they believe in rather than merely trying to hold on to what seats they have. Moreover, claims from Joe Manchin et al. that politics should be kept out of the judiciary are weak sauce when politics so clearly stand behind the decision to nominate Neil Gorsuch in the first place. If Dems like Claire McCaskill want votes from Bernie Sanders supporters, they can’t just ask for it—they have to earn it. That is, they have to demand the kind of change that authentically speaks to the needs of their rank-and-file constituents, and not merely count on voters’ ability to distinguish their policies from those of the GOP, especially when calling for incremental or middling reforms. Otherwise, with Democrats like these, who needs Republicans?

Replacing Justice Scalia with, Well, Justice Scalia

On the eve of the start of Black History Month, President Donald Trump didn’t disappoint his conservative fans or white supremacist supporters when he announced his nomination of silver-haired white dude Neil Gorsuch to fill the vacancy in the Supreme Court left when Justice Antonin Scalia left this Earth and departed for that big courthouse in the sky. Gorsuch, despite being the youngest SCOTUS nominee in a quarter of a century, has the pedigree of a Supreme Court Justice. He’s studied at Columbia, Harvard, Oxford—not a shabby hand, eh?—and in terms of his professional career, he’s been a clerk for a United States Court of Appeals judge and two Supreme Court Justices (Byron White and Anthony Kennedy), worked in a D.C. law firm, was principal deputy to Associate Attorney General Robert McCallum at the DOJ, spent time as a Thomson Visiting Professor at the University of Colorado Law School, and has served in his current role as a judge on the U.S. Court of Appeals for the Tenth Circuit out of his duty station in Denver, Colorado.

In other words, Judge Gorsuch is, unlike a number of Trump’s picks for his Cabinet, eminently qualified for the position for which he has been tapped, and for that, I respect the man. Do I think he should be confirmed as the next Supreme Court Justice, however? In a word, no. It’s nothing personal. I mean, heck, I didn’t know who the guy was until Pres. Trump’s prime-time announcement. Regardless, as I’m sure a number of key Democrats do, I have concerns about his priorities as a jurist and whether or not he would let his political and personal/spiritual ideologies interfere with his interpretation of the Constitution as a member of SCOTUS. Accordingly, I feel the Dems should take their time and do their due diligence before rubber-stamping Neil Gorsuch into service on the highest court in the country. After all, and if nothing else, it’s only fair.

On that last note, let’s take a few steps back and consider the current political climate in which we’re operating. In a vacuum, given his extensive experience, Gorsuch might not be considered a terrible pick, or at the very least, Democrats might have been more willing to work with the Trump administration and Republicans on moving along the confirmation process at a brisker pace. With Pres. Trump in the midst of signing a slew of grotesque executive orders to start his tenure in the Oval Office, however, and in light of the GOP’s obstruction of the Democrats’ own pick to fill Scalia’s vacant seat in the Supreme Court in the remaining months of President Barack Obama’s run as Commander-in-Chief, a measure of resistance on the Dems’ part might not only be advisable, but warranted.

Antonin Scalia died on February 13, 2016, and Obama officially nominated Merrick Garland to fill Scalia’s vacancy on March 16, 2016. The move on President Obama’s part to pick Garland, in addition to selecting someone highly experienced in his own right, was intended to force the hand of Republicans in the Senate. Would GOP lawmakers confirm Merrick Garland and resign to having a Supreme Court Justice many of them admired, but wasn’t as conservative as the more vocal factions within their ranks would have liked, or would they be a dick about things and refuse to hear Garland on principle that he was Obama’s choice and therefore had to be neutralized? Um, I think you know where this is going. Senate Majority Leader Mitch McConnell and the Republicans chose to be a dick about things. No hearings. No votes. Nothing. Essentially, they refused to do their jobs, claiming they lacked sufficient time to process Garland’s nomination and that the incoming President should decide who fills the vacant SCOTUS seat—even though they realistically had plenty of time to respond to Merrick Garland’s bid, and there was no standard or tradition which prevented a President of the United States from nominating someone to fill a sudden vacancy in his or her final year in office. Yup, Senate Republicans were being huge dicks.

Now, of course, the shoe is on the other proverbial foot, with of course the difference being that the Republicans had a majority in the Senate then and do now, which explains why they’ve been so keen to try to ram-rod President Trump’s Cabinet picks through the confirmation process. Not only do Republican leaders seek this treatment with Neil Gorsuch, however, but to an extent, they seem to expect it. The aforementioned Mitch McConnell had this to say about what he hopes to see from his Democratic Party counterparts:

In the coming days, I hope and expect that all Senate colleagues will give him fair consideration just as we did for the nominees of newly-elected presidents Clinton and Obama. This is a judge who is known for deciding cases based on how the law is actually written, even when it leads to results that conflict with his own political beliefs. He understands that his role as a judge is to interpret the law, not his own viewpoint.

Well, Sen. McConnell, you certainly talk a good game. Indeed, McConnell is not the only person to speak highly to Gorsuch’s credentials or his education, and Trump’s nominee has been known to diverge from his conservative principles when it suits him. Still, this blanket praise for Judge Gorsuch seems to be what we should anticipate from our federal jurists at somewhat of a minimum. Deciding cases based on how the law is actually written, interpreting the law and not one’s own viewpoint—these, one might argue, are important ethical standards for any judge. That is, Neil Gorsuch shouldn’t be assumed to be or propped up to be superior to other judges just by virtue of remaining free from bias. By this token, we should ask nothing less of the man, especially if he is to take up residency on the Supreme Court.

As for the timing of the SCOTUS nomination, Mitch McConnell conveniently leaves out what happened not at the onset of Barack Obama’s tenure, but in its twilight: that of the refusal to even dignify Merrick Garland’s nomination with a response. Thus, if Republicans are indignantly claiming that Democrats delaying votes to request additional disclosures from and information about key Cabinet picks or seeking to drag their feet on confirming Mr. Gorsuch is fundamentally and substantially different from their move to block Garland’s nomination so as to eliminate their chance of replacing the late Antonin Scalia with someone other than another version of him, let me not mince words by offering that this is complete and unmitigated bullshit. 

Moreover, claiming that “the people” should be effectively allowed to pick the next Supreme Court Justice nominee by choosing the President is also balderdash, hogwash, and poppycock. Not only should politics not get in the way of going through the motions on reviewing a candidate for a SCOTUS vacancy (i.e. if you want to be dicks and refuse him after giving him a hearing, OK, but at least give him that), but numerous constituents did use their voice during the months of the GOP refusal to acknowledge President Obama’s nomination, and it was in protest, with the common refrain from those in dissent being “Do your job!” Especially for members of a political party that has made it a habit of treating those buoyed by the social safety net as lazy, shiftless sorts, refusal by Republican Party leaders to entertain Obama’s selection in the name of politics could be seen as blatantly hypocritical. At any rate, rather than heed the desires of all their constituents, Mitch McConnell and Co. catered to their base. Not terribly surprising, but ideally, not how lawmakers professing to act in everyone’s best interests should be acting.

Before we get ahead of ourselves in conceiving of Democratic Party resistance to Donald Trump’s nomination for the Supreme Court as political ransom, if not brinkmanship, it should be stressed that key Democrats do see legitimate reasons, if not to vote against Neil Gorsuch outright, to, if nothing else, demand the chance to engage him directly on his views and trends within his judicial record. Richard Primus, in a well-thought-out piece about Gorsuch for Politico, identifies him by the designation “Scalia 2.0,” a nod which probably won’t gain him much traction with Scalia 1.0’s detractors. This passage, in particular, perhaps best encapsulates the thrust of Primus’s article, and in doing so, puts President Trump’s nomination in a historical context:

The most sensible way to think of Gorsuch may therefore be to imagine what Scalia might have been if he had come along thirty years later. Scalia came of age at a time when legal conservatives were doing battle with a relatively liberal Supreme Court. Perhaps not surprisingly, they framed their views in terms of judicial restraint and deference to majoritarian lawmaking. Gorsuch’s generation of conservatives, which has lived its whole adult life with a more conservative Court, seems more inclined to see majoritarian regulation as the problem and the judiciary as a good solution.

If Richard Primus makes this very general distinction, though, why the allusion to Judge Gorsuch as a new version of Justice Scalia? Despite the two men operating or coming of age, so to speak, in different eras, they share the same staunchly conservative views on a number of key issues, including abortion, affirmative action, capital punishment, and firearms, which obviously appeals to the right. Meanwhile, noting the divergence within the quoted passage above, Neil Gorsuch tends to differ from Antonin Scalia on the dimension of the role of the courts in relation to business regulation, favoring instead greater judicial discretion and, therefore, diminished capacity for regulatory agencies to interpret existing statutes, and on the specific issue of the First Amendment, Gorsuch appears inclined to view “religious freedom” more expansively, which would stand to give businesses and closely-held corporations more leeway in how they operate and how they pay their taxes (or don’t). Again, a seeming victory for the religious right, notably evangelicals, who came out strongly for Trump in the 2016 election. In all, the concern is that Judge Gorsuch, as a Justice on the Supreme Court, would favor corporate interests over the concerns of average Americans, and would emphasize “religious freedom” over individual liberties and freedom from discriminatory business practices.

In all, representatives from both parties would appear to have important decisions to make in the coming days and weeks regarding Neil Gorsuch’s nomination. For Democrats, the chief concern is whether or not they should compel Republicans to seek 60 votes to confirm President Trump’s nominee. Under a procedural vote known as cloture, the minority party in the Senate has the ability to require the approval of 60 senators to end the debate over a candidate for a position as vital as Supreme Court Justice and advance to an up-or-down vote. Senate Minority Leader Chuck Schumer, for his part, has indicated his party’s intention to seek this strategic avenue rather than to acquiesce Gorsuch’s confirmation, though some Democrats conceivably could be concerned about employing this tactic only to have it used against them in the future, and would accordingly opt to fight harder another day on another issue.

Republicans, meanwhile, could override the 60-vote requirement of the cloture-filibuster-strategic-thing-a-ma-jig—you know, assuming the Dems actually go ahead with a unified front in favor of such a maneuver—by making use of the so-called “nuclear option.” This would involve an actual change of the rules for filibustering a Supreme Court nominee, enabling the GOP to push Neil Gorsuch through the confirmation process like poop through a goose. Donald Trump, because he is a big, stupid baby and wants to get his way all the time, has advised his Republican confederates to use the nuclear option at first sign of a potential deadlock on Gorsuch’s nomination. (Side note: even when not involving actual nuclear weapons, Trump seems way too eager to use the nuclear option. Dude may have a nuke problem, in fact. Just saying.) Understandably, despite their recent history of dickishness, Republican leaders may be reluctant to “go nuclear,” along similar lines as to why Democrats might be hesitant to insist on 60 votes to confirm Judge Gorsuch. As this report by Jake Miller for CBS News details, such a rule change would come fairly close on the heels of a shift in 2014 to require only a 51-vote majority to confirm non-Supreme Court judiciary and executive branch nominees, and could be seen as greasing the ever-slippery slope away from what many would argue is a necessary system of checks and balances for the federal government. Besides, they, too, by changing the rules of the engagement, run the risk of having this tactic turned around on them.

I, of course, as a registered Democrat and as someone who would like to see the Democratic Party regain control of the Senate, if not the House and White House eventually as well, have a dog in this fight over Justice Antonin Scalia’s vacant seat on the Supreme Court. Perhaps unsurprisingly, I hope Senate Democrats filibuster the nomination of Neil Gorsuch, and do whatever is in their power to prolong the confirmation process in light of ideological differences they have with Judge Gorsuch. You know, push back a little. Show us party supporters you have a backbone, for Christ’s sake! Granted, challenging Republicans on the Gorsuch nomination and taking back control of the executive and legislative branches is only as good as the commitment to truly progressive policies and principles, something which isn’t exactly guaranteed from a party that just went all in on Hillary Clinton as its presidential nominee. In the short term, however, Neil Gorsuch can and should be resisted as an extension of Donald Trump’s and the GOP’s pro-business, anti-personal-freedom agenda. Case closed.

I know we’re fewer than 100 days away from the presidential election. I know the stakes are high, especially in the eyes of the large bloc of Americans who imagine a Donald Trump presidency would result in absolute disaster, as well as in the eyes of concerned and incredulous onlookers in foreign countries. I even know that you know that I know that I go psycho when my new joint hits, that I just can’t sit, and furthermore, that I must get jiggy with it. All this notwithstanding, let’s put aside the craziness of the race to the White House for a moment and consider that once the votes in the general election are counted and in the books—mostly correctly, we hope—this will not be the end of elections to come. Provided, you know, the winner doesn’t manage to blow Earth up before the end of 2017.

Yes, I’m talking about mid-term elections, particularly those for challenged and vacant spots in the House of Representatives and the Senate, as well as state governors and legislatures. For all the pomp and circumstance that surrounds the presidency, the primary season and party conventions—and the balloons, sweet Jesus, all those balloons—voting for members of Congress and gubernatorial candidates may be as critical to our sense of being represented in governmental affairs, perhaps even more so, than the vote we cast for Hillary Clinton, Donald Trump, or a third-party candidate we might actually like. This is where the cautionary tale of the 2010 mid-term elections fits in. At that time, a lot was going on economically as well as politically. Two years earlier, the country elected its first African-American president in Barack Obama, who ascended to the top office in the country on a platform of hope, change and “YES WE CAN!” Unfortunately for Obama, his vision, which may have lacked some degree of practicality, was already bound to be constrained by the effects of the “Great Recession,” an event we’re told is over, and yet, things are not all that peachy, rosy or whatever word you like that has been mostly sapped of authentic meaning, for the average American.

But yes, in terms of the mid-term election aspect, six years ago, the House of Representatives, for one, saw massive upheaval, with the Republican Party gaining 63 seats, recapturing the majority in the House, and winning the most dramatic turnover in U.S. history since 1948. Republicans also saw a net gain in the Senate and among state governors, and furthermore, gained 680 seats in state legislatures, ensuring the GOP would have control of a majority of the fifty states. What prompted this Republican uprising, if you will? As you might expect, there are a number of variables at play here. Certainly, economic factors played a large role, as voters were concerned about health care costs (esp. those following the passage of the Affordable Care Act a.k.a. ObamaCare), taxes, and unemployment rates, and many of them were upset at how easily Wall Street got its bailout seemingly without proportionate relief for the so-called “99%.” On this front, the Tea Party movement led the charge, elevating the economy as the top issue among independents and Republicans, as well as elevating itself in terms of political prominence. This is not to say that social issues completely fell by the wayside, however. Immigration reform, in particular, grew legs, particularly in states that are more likely to be affected by illegal immigration, and in turn, more readily see this subject as a challenge rather than an opportunity. Arizona SB 1070, most notably (or notoriously), was indicative of a cultural backlash against trends in undocumented immigration—real or imagined.

So, yes, in a nutshell, based on the state of the economy and jobs, and owing to changing laws and regulations regarding health care in the United States and immigration policy, among other areas, 2010 saw a significant shift in the political landscape. With specific respect to the Tea Party and its remnants, while Ron Paul is seen by some conservatives as a “godfather” of sorts—even if he is not an explicit founder of the theory behind the movement—other, shall we say, less respected political minds found themselves in positions of at least nominal influence by riding its wave of enthusiasm: Glenn Beck, Jim DeMint, Michele Bachmann, Sarah Palin, just to name a few. Even today, leaders at the state and national level with ties to the Tea Party movement or sympathetic to its broad aims continue to play a notable part in the nation’s politics, including Louie Gohmert (Texas), Matt Bevin (Kentucky), Mike Pence (Indiana, and now, Trump’s VP pick), Paul LePage (Maine), Rand Paul (Kentucky, and son of Ron Paul), Steve King (Iowa), and the man everyone apparently loves to hate, Ted Cruz (Texas). I acknowledge, as a self-described liberal and supporter of progressive politics, that I disagree with a number of these figures on matters of policy, so I am not all that objective in assessing their viability for public office. That said, a number of these men and women are—and I’m putting this as nicely as I can—complete and utter morons. So, if you’re part of the large segment of Americans who think the country has gone to shit and that our political leaders aren’t doing much about it, you can, in part, blame the lot of them.

But are we, as voters, somewhat culpable in allowing a bunch of know-nothings and numb-nuts to run the show? Maybe, just maybe. I don’t always enjoy Samantha Bee’s material on Full Frontal, especially when she insinuates that anyone who won’t vote for Hillary Clinton is either sexist, stupid or both, but in speaking about the 2010 mid-terms, or what she refers to as “the most important election you didn’t bother to vote in,” she highlights how demographics factored significantly in the election results. Turnout among minorities and younger adults was relatively low in the 2010 mid-term elections, paving the way for voters mostly over the age of 45, predominantly white, and overwhelmingly, as Bee puts it, “cranky” (read: racists who don’t like the idea of a black president). By extension, these results paved the way for, among other things, a partisan battle over the Affordable Care Act which prompted a government shutdown in 2013, no real progress on immigration reform, and as one of the rings of the proverbial ripple effect of dropping a stupid Republican rock in America’s political waters, made Congress so unpopular that Donald Trump circa 2015/2016 seems like a good idea to many. It’s a bit of an oversimplification, but Samantha Bee’s analysis isn’t wildly out of bounds.

Either way, the emphasis is on more than the general election. It’s about those ripples after the fact that manifest in the form of political mobilization and voter turnout for local, county and state elections. Going back to the 2010 mid-terms, the kind of sweeping victories garnered by lawmakers under the GOP banner afforded them the power to do—or not do—what they want, more or less. When the mood or issue suited them, as with approving a repeal of ObamaCare, defunding Planned Parenthood or green-lighting ungodly amounts of military spending, they could at least railroad legislation through the House of Representatives owing to their majority. When a bill or executive order didn’t tickle their fancy, as with background checks for gun ownership, banking reform, closing Gitmo or, heck, even hearing a Supreme Court justice nomination, they could be every bit the obstructionist Congress they have been known to be of late, or as the turtle-faced Mitch McConnell would have it, not even doing their job. It has oft been said “to the victor go the spoils,” but following the sizable gains of the 2010 elections, Republicans have taken that idea and run with it, treating their victories as mandates of some sort, or otherwise all-too-appropriately acting like spoiled brats with said spoils, refusing to compromise and stubbornly pressing on with their agendas despite record lows in approval rating.

This is why—whatever happens come November—the results of the presidential election are not the end game, and consummate with this notion, if you feel like I feel, no sooner than these votes are tallied should attention be levied to organizing and rallying the proverbial troops to make sure the GOP doesn’t maintain/establish a death grip on state executive offices and legislatures, as well as federal public offices. That’s why the threat of a Donald Trump presidency looms so large—not so much because of what damage Trump himself might do while holding the nation’s top office (though that is a very real concern), but how it would stand to produce a ripple effect of galvanizing other bigots and individuals with little sense and few legitimate qualifications to serve the public interest to try to run for public office in their own right. David Duke—yes, that David Duke—has announced his bid for a Louisiana state Senate seat. The American Nazi Party—are you sensing a theme here?—has also expressed its desire to be relevant in a political sense, believing as many as three of every four Trump supporters would support their candidates as well.

Donald Trump’s securing a major-party presidential nomination has emboldened unabashed racists, and the logical conclusion is that they feel Trump and others within the GOP sanction their brand of prejudice. Average white voters, feeling alienated by a federal government they feel has neglected their needs and wants, and all around believing that “their country” and way of life is being taken away (Jon Stewart, ever the sage, recently challenged this assertion), see and hear in the Republican Party nominee a voice that “says what they’re thinking.” Of course, those of us who would never vote for Donald Trump might naturally react by insisting, repulsed, that those who think like Trump might not be, deep down, good people. At the same time, however, one has to admit that establishment Democrats and Republicans alike haven’t exactly embraced working-class Americans as well as they could or should have recently, being more concerned with winning elections, appeasing big-money donors and lobbies, and preserving the status quo. Granted, poor and working-class minorities have a yet bigger gripe on this end, but with income and wealth inequality expanding by leaps and bounds, people in this country of all sizes, shapes and shades are being ignored, or at least taken for granted.

Aside from the idea Donald Trump is a bully, fraud, liar, man-child, racist, sexist and xenophobe, this potential empowerment of white supremacists and others who may not be out-and-out Nazis but still shouldn’t be running for public office is a big reason why, in their hatred of Hillary Clinton, Bernie-or-Busters/disenfranchised independent voters shouldn’t flock to her Republican rival in an effort to stick it to HRC and the DNC. As I see it, if you don’t want to vote Clinton, your next best bet is to vote your conscience, whether that is best reflected by Jill Stein of the Green Party or Gary Johnson of the Libertarian Party; that, to me, sends the clearest message to the Democratic Party that its leadership has work to do to engage your values and earn your vote in 2018 or 2020. Or you could write in Bernie Sanders, if it makes you happy. Or just don’t go to the polls at all. A vote for Donald Trump, if nothing else, to blow things up and to hasten a progressive uprising, is making a deal with the Devil, and rewards Trump and the GOP for running a campaign marked by bad behavior, divisiveness and hate. This is to say, if one views Hillary Clinton as “the enemy,” well, Donald Trump and the Republican Party aren’t your friends either.

Returning to the concept of the proletariat, if you will, in the United States being subjugated by the machinations of the bourgeoisie, though not a perfect analog to Trump’s rise (how does anyone prove a true analog to that?), Bernie Sanders’ rise in the national profile and his widespread appeal among progressives and younger voters is fundamentally important because his so-called political “revolution” speaks to the long haul. As Sanders himself has expressed—and must keep expressing to his supporters who think voting for Trump is a good idea—America must prevent Donald Trump from ascending to the role of Commander-in-Chief, and though he differs from Hillary Clinton on key points, he supports her bid for the presidency to achieve this goal. This is just the immediate concern of his political movement, however. Following the presidential election, Bernie has made it clear that the Democratic Party and/or third parties need to embrace younger voters and working-class Americans alike as a basis of its diversity and strength, and in doing so, support progressives running for office.

To this end, Bernie Sanders is spearheading something he calls Our Movement, which, beyond asking for more contributions is pretty vague, but reportedly, the organization will continue the spirit of grassroots support for progressive candidates for public office—presumably Democrats, but potentially independents as well. Obviously, the proof is in the pudding when it comes to the ability to generate donations, as Sanders supporters who already feel as if they’ve given their fair share, or otherwise feel cheated by the Democratic National Committee and possibly Bernie himself in endorsing the much-despised Hillary Clinton, may not be as willing to pony up for the sake of down-ticket Dems and non-affiliated office seekers. For those who aren’t asking for their campaign donations back and who are committed to sustaining a durable movement toward reducing the influence of corporate interests in politics, meanwhile, Our Movement could be the start of a sizable force in American politics. You know, especially when it gets some actual details about its agenda to its name.

We can debate whether or not we believe Donald Trump might actually be better as President of the United States in the grand scheme of things because the inevitable progressive backlash would be more profound than anything that might manifest if Hillary Clinton were to be elected President; with that, the conservative call to arms which could spring to life if HRC becomes POTUS might just set back the goal of Democrats reclaiming Congress and state governments from the Republican Party. Personally, I wouldn’t invite Trump into the Oval Office just like I wouldn’t invite a pack of wolves to look after a toddler, but we can agree to disagree. Regardless of who wins and who loses in the general election, it is incumbent upon supporters of the Democratic Party, especially its representatives who embrace more progressive bits of policy, to approach voting in mid-term elections in 2018—and even getting out the vote for down-ticket candidates this November—with the same sense of zeal as millennials attending a Bernie Sanders rally, or gun activists lobbying against background checks and other reforms (on that last note, I’m not sure anyone can match the fetishistic fervor with which the NRA and their ilk stand in the way of progress on gun control, but one can sure try). You know, lest we undergo a repeat of the 2010 fiasco.

It’s been said anywhere from half to 80% or 90% of the battle is showing up, and in a representative democracy characterized by a broken or “rigged” system, this seemingly has never been more accurate. If we the people are going to make a splash and take charge of how our elected representatives respond to our needs, we’re going to need to understand and appreciate the ripple effects from each presidential election. The time, my friends, is now.
